Tilleke & Gibbins 2022 Annual Employment Law Forum: English-Language Sessions

Tilleke & Gibbins’ regional employment team presented two sessions on employment law issues in Southeast Asia as part of the 2022 Annual Employment Law Forum.

On November 29, the forum featured a session titled “Poor Performance Terminations in Cambodia, Laos, Myanmar, Thailand, and Vietnam,” with presentations by Dino Santaniello (Laos), Nitikar Nith (Cambodia), Pimvimol Vipamaneerut (Thailand), Sarah Galeski (Vietnam), and Yuwadee Thean-ngarm (Myanmar).

On November 30, Chitchai Punsan highlighted criminal proceedings relating to Thailand’s Labour Protection Act B.E. 2541 (1998). The session covered potential responsible parties, different types of criminal offenses, and criminal proceedings.

On December 7, Suruswadee Jaimsuwan and Pathanin Sornchangwat concluded the final presentation of the webinar series with an English presentation titled, “Exploring Complex Procedural Laws in Labor Disputes: Class Actions and Arbitration.”

Tilleke & Gibbins’ Employment Law Forum is an annual event featuring insights on relevant laws and regulations for employers in Thailand and the region. The forum this year also featured several sessions in Thai.

Thammapas Chanpanich, an associate at the firm’s corporate and commercial group in Bangkok, was recently featured on the The JSIG Privacy Deep-Dive podcast, which explores the latest trends and developments in data privacy law through interviews with leading experts and practitioners in the field. In the episode, Thammapas joined host Larisa Munteanu for a wide-ranging discussion on data privacy. Thammapas, a Certified Information Privacy Professional (CIPP/E), shared her experience in achieving the certification and her recent attendance at the AIJA – International Association of Young Lawyers Awards in Singapore. She also discussed with the host the progress of data privacy laws in Thailand, and the international influence of the European Union’s General Data Protection Regulation (GDPR). Thammapas offered insights into the challenges and opportunities presented by data privacy regulations, and how companies can best navigate the complex regulatory landscape. On August 16, Tilleke & Gibbins collaborated with Eiger in Taiwan to host a webinar on franchising law in Taiwan and Thailand. The webinar aimed to help international brand owners better understand the legal landscape of both jurisdictions. The Thailand section was presented by Alan Adcock, partner, and Sher Hann Chua, consultant, both from the firm’s intellectual property group in Bangkok, while Eiger provded the perspective from Taiwan. hey provided a comprehensive summary of the following key considerations: Legislative framework for franchises in Taiwan Legislative framework for franchises in Thailand Comparison of key regulations – similarities and differences Enforcement of foreign arbitral awards in franchise agreements, including case studies Five common pitfalls facing franchises Two webinar sessions were conducted to accommodate companies in different parts of the world. On June 29, 2022, Tilleke & Gibbins collaborated with K&L Gates Straits Law LLC to offer a timely webinar entitled “Current Climate for Investments: Concerns for Investment Structuring & Disputes in Southeast Asia.” During the session, two attorneys from Tilleke & Gibbins’ dispute resolution group in Bangkok—John Frangos, partner and director, and Eric Meyer, consultant, highlighted different global pressures affecting investment in Southeast Asia, and pointed out key considerations for investors in relation to their future investments. Together with the speakers from K&L Gates, John and Eric provided an introduction to investment treaties in several jurisdictions and potential disputes that could arise due to the current investment climate. On May 3, David Mol, associate in the firm’s Phnom Penh office, delivered an American Chamber of Commerce in Cambodia webinar entitled “An Overview of Consumer Product Regulations in Cambodia: Standards, Registrations, and Labeling.” The webinar aimed to provide attendees with an understanding of the legal framework surrounding consumer products in Cambodia. In the session, David addressed compliances requirement for consumer products in Cambodia, including: Meeting mandatory product standards; Fulfilling mandatory product registration; and Complying with legal labeling requirements.
