On January 27, 2022, lawyers in Tilleke & Gibbins’ dispute resolution group collaborated to address class-action proceedings in Thailand, which are still relatively new after amendments to the Civil Procedure Code in 2015 made class actions possible. Titled “Considerations for Potential Defendants in Class Actions in Thailand,” Anyamani Yimsaard, Eric M. Meyer, and Suruswadee Jaimsuwan from the firm’s dispute resolution group in Bangkok jointly covered the following topics Overview of the types of class actions that have been filed in Thailand; Considerations and potential options for companies who are forced to defend against a class action; and Penalties and fees for which a class action defendant could potentially be liable. On December 13, Eric M. Meyer, consultant, and Suruswadee Jaimsuwan, counsel, both from the firm’s dispute resolution department in Bangkok, teamed up in a webinar titled, “Class Actions in Thailand: A Look Back at the Law, a Look Ahead at Potential Trends.” Hosted by the Legal Committee of the American Chamber of Commerce in Thailand, Suruswadee and other speakers discussed: An overview of Thailand’s class action law and the types of cases that have been filed since its enactment; Local and global trends in class actions; and How these trends could potentially appear in Thailand. On October 27, Tilleke & Gibbins’ dispute resolution group in Bangkok teamed up with consulting firm KPMG to offer a webinar titled “Business Rehabilitation in Thailand: Considerations for Debtors and Creditors.” The webinar aimed to help companies better understand the rehabilitation process as they look ahead toward the post-COVID-19 environment. During the session, Alongkorn Tongmee, senior associate; Jamorn Pornponwat, associate; and John Frangos, partner, introduced the Thai business rehabilitation process and detailed the objectives and benefits of rehabilitation, notable legal challenges, and key considerations that debtors and creditors should keep in mind if they become involved in business rehabilitation in Thailand. On September 28, Tilleke & Gibbins’ corporate and commercial group and dispute resolution group hosted a webinar titled “Land Acquisition for Industrial Purposes” to provide foreign companies with some insight into Thailand’s sometimes complex regulations. In the first part of the webinar, Chaiwat Keratisuthisathorn and Chanchai Jhongsathit of Tilleke & Gibbins’ corporate and commercial department discussed foreign land ownership restrictions in Thailand, explained key steps to acquire land for industrial purposes, explained the process of conducting land due diligence, addressed sale and purchase agreements, and outlined the process of registering land transfers. In the second part of the session, Alongkorn Tongmee and Jidapa Srisummacheep of the firm’s dispute resolution department provided an overview of litigation in Thailand, spoke about Thailand’s court system, addressed different types of civil disputes, explained initiation of criminal action between the police and the court, and clarified special considerations for real estate disputes.
