Tilleke & Gibbins’ regional employment team presented two sessions on employment law issues in Southeast Asia as part of the 2022 Annual Employment Law Forum.

On November 29, the forum featured a session titled “Poor Performance Terminations in Cambodia, Laos, Myanmar, Thailand, and Vietnam,” with presentations by Dino Santaniello (Laos), Nitikar Nith (Cambodia), Pimvimol Vipamaneerut (Thailand), Sarah Galeski (Vietnam), and Yuwadee Thean-ngarm (Myanmar).

On November 30, Chitchai Punsan highlighted criminal proceedings relating to Thailand’s Labour Protection Act B.E. 2541 (1998). The session covered potential responsible parties, different types of criminal offenses, and criminal proceedings.

On December 7, Suruswadee Jaimsuwan and Pathanin Sornchangwat concluded the final presentation of the webinar series with an English presentation titled, “Exploring Complex Procedural Laws in Labor Disputes: Class Actions and Arbitration.”

Tilleke & Gibbins’ Employment Law Forum is an annual event featuring insights on relevant laws and regulations for employers in Thailand and the region. The forum this year also featured several sessions in Thai.

On January 27, 2022, lawyers in Tilleke & Gibbins’ dispute resolution group collaborated to address class-action proceedings in Thailand, which are still relatively new after amendments to the Civil Procedure Code in 2015 made class actions possible. Titled “Considerations for Potential Defendants in Class Actions in Thailand,” Anyamani Yimsaard, Eric M. Meyer, and Suruswadee Jaimsuwan from the firm’s dispute resolution group in Bangkok jointly covered the following topics Overview of the types of class actions that have been filed in Thailand; Considerations and potential options for companies who are forced to defend against a class action; and Penalties and fees for which a class action defendant could potentially be liable. On December 13, Eric M. Meyer, consultant, and Suruswadee Jaimsuwan, counsel, both from the firm’s dispute resolution department in Bangkok, teamed up in a webinar titled, “Class Actions in Thailand: A Look Back at the Law, a Look Ahead at Potential Trends.” Hosted by the Legal Committee of the American Chamber of Commerce in Thailand, Suruswadee and other speakers discussed: An overview of Thailand’s class action law and the types of cases that have been filed since its enactment; Local and global trends in class actions; and How these trends could potentially appear in Thailand. Suebsiri Taweepon, a partner in Tilleke & Gibbins’ intellectual property group, and Nopparat Lalitkomon, a senior associate in the firm’s corporate and commercial group, were recently invited to be guest contributors for True Digital Park’s (TDPK) Thailand GameChanger—a weekly podcast that explores the startup ecosystem in Thailand and across Southeast Asia. During the session, Suebsiri and Nopparat shed light on a number of common legal pitfalls for Thai startups, including discussions on: the importance of getting internal and external legal documents right from the start; non-disclosure agreements and whether or not they’re enforceable; what needs to change for more startups to incorporate in Thailand; and regulations around cryptocurrencies, non-fungible tokens, and asset fractionalization. On December 9, lawyers from Tilleke & Gibbins’ offices in Cambodia, Laos, and Myanmar contributed to a webinar entitled “How to Export Cosmetics to Cambodia, Laos, and Myanmar,” cohosted by life sciences consultancy Chemlinked. During the webinar, Aye Thuzar Hlaing, an associate in Tilleke & Gibbins’ Myanmar office; David Mol, an associate in the firm’s Phnom Penh office; Dino Santaniello, head of Tilleke & Gibbins’ office in Laos; and Yuwadee Thean-ngarm, director of the firm’s Myanmar office, took turns presenting on the process of exporting cosmetics to each jurisdiction. Specific topics included the following Overview of cosmetics regulations in each jurisdiction; Key elements of the regulatory framework; Compliance requirements and labeling essentials; and Practical advice for foreign cosmetic brands on how to comply with local regulations.
