Tilleke & Gibbins 2022 Annual Employment Law Forum: English-Language Sessions

Tilleke & Gibbins’ regional employment team presented two sessions on employment law issues in Southeast Asia as part of the 2022 Annual Employment Law Forum.

On November 29, the forum featured a session titled “Poor Performance Terminations in Cambodia, Laos, Myanmar, Thailand, and Vietnam,” with presentations by Dino Santaniello (Laos), Nitikar Nith (Cambodia), Pimvimol Vipamaneerut (Thailand), Sarah Galeski (Vietnam), and Yuwadee Thean-ngarm (Myanmar).

On November 30, Chitchai Punsan highlighted criminal proceedings relating to Thailand’s Labour Protection Act B.E. 2541 (1998). The session covered potential responsible parties, different types of criminal offenses, and criminal proceedings.

On December 7, Suruswadee Jaimsuwan and Pathanin Sornchangwat concluded the final presentation of the webinar series with an English presentation titled, “Exploring Complex Procedural Laws in Labor Disputes: Class Actions and Arbitration.”

Tilleke & Gibbins’ Employment Law Forum is an annual event featuring insights on relevant laws and regulations for employers in Thailand and the region. The forum this year also featured several sessions in Thai.

On November 10, Tilleke & Gibbins hosted a webinar in collaboration with the Australian Chambers of Commerce in Cambodia, Laos, and Myanmar to address current labor practices and core legal obligations across the region. The webinar featured Dino Santaniello, head of Tilleke & Gibbins’ office in Laos; Jay Cohen, director of Tilleke & Gibbins’ Cambodia office; Sochanmalisphoung Vannavuth, an associate from Tilleke & Gibbins’ Cambodia office, and Yuwadee Thean-ngarm, director of Tilleke & Gibbins’ Myanmar office. The speakers provided a comprehensive overview of employment contracts and employment rights in their respective countries, outlined taxes and social security schemes, laid out termination policies, and addressed vaccine mandates and data privacy requirements that companies must comply with in each country. On October 28, Hien Thi Thu Vu, head of Tilleke & Gibbins’ regulatory affairs team in Vietnam, delivered a presentation titled “How to Export Cosmetics to Vietnam,” in collaboration with the life sciences consultancy ChemLinked to help foreign companies navigate key areas in the local legal framework. During the session, Hien provide an overview of cosmetics regulations in Vietnam, identified key elements of the regulatory framework, discussed compliance requirements and labeling essentials, and shared practical advice for cosmetic companies that wish to export their products to Vietnam. On October 27, Tilleke & Gibbins’ dispute resolution group in Bangkok teamed up with consulting firm KPMG to offer a webinar titled “Business Rehabilitation in Thailand: Considerations for Debtors and Creditors.” The webinar aimed to help companies better understand the rehabilitation process as they look ahead toward the post-COVID-19 environment. During the session, Alongkorn Tongmee, senior associate; Jamorn Pornponwat, associate; and John Frangos, partner, introduced the Thai business rehabilitation process and detailed the objectives and benefits of rehabilitation, notable legal challenges, and key considerations that debtors and creditors should keep in mind if they become involved in business rehabilitation in Thailand. On September 28, Tilleke & Gibbins’ corporate and commercial group and dispute resolution group hosted a webinar titled “Land Acquisition for Industrial Purposes” to provide foreign companies with some insight into Thailand’s sometimes complex regulations. In the first part of the webinar, Chaiwat Keratisuthisathorn and Chanchai Jhongsathit of Tilleke & Gibbins’ corporate and commercial department discussed foreign land ownership restrictions in Thailand, explained key steps to acquire land for industrial purposes, explained the process of conducting land due diligence, addressed sale and purchase agreements, and outlined the process of registering land transfers. In the second part of the session, Alongkorn Tongmee and Jidapa Srisummacheep of the firm’s dispute resolution department provided an overview of litigation in Thailand, spoke about Thailand’s court system, addressed different types of civil disputes, explained initiation of criminal action between the police and the court, and clarified special considerations for real estate disputes.
