Biography

Tu Anh Tran is an associate with T&G Law Firm LLC (TGVN), a licensed law firm and IP agent that partners with Tilleke & Gibbins for local IP filings and litigation in Vietnam. Recognized as a “Leading Associate” in the field of Arbitration by The Legal 500 and a “Future Star” in the field of Commercial and Transactions by Benchmark Litigation, Tu advises and represents clients in resolving commercial disputes by means of court litigation, arbitration, and other ADRs, recognition and enforcement of foreign court judgments and arbitral awards, aircraft registration and repossession, and other complex matters.

Before joining TGVN, Tu was a legal collaborator at the Vietnam International Arbitration Centre (VIAC). Tu assisted VIAC’s Secretariat and tribunals in administering numerous arbitration cases in a wide range of fields, enabling him to handle arbitration matters efficiently. He also has substantial experience in the aviation sector, and assists clients with aircraft-related interest registrations and repossession. In addition, he assists with IP enforcement matters with the authorities of Vietnam and is active in pro bono activities regarding IP and arbitration.

Tu is a licensed lawyer and a member of the Chartered Institute of Arbitrators (MCIArb), and has completed with distinction various international arbitration and mediation courses organized by ICC, CIArb, VIArb, and Arbitration Lab.

Experience

  • Advised and assisted on the first hostile aircraft repossession case in Vietnam against a defaulting Vietnamese airline with a value of over USD 270 million, setting the very first precedent of aircraft export via IDERA since Vietnam’s accession to the Cape Town Convention in 2014.
  • Advised and assisted a Singaporean-based multinational company in disputes with a Vietnamese state-owned enterprise before VIAC. The disputes had a total value of over USD 25 million and were related to energy projects.
  • Advised and represented a U.K. fund management company in an aviation-related administrative dispute involving the aviation authority of Vietnam before Vietnamese courts.
  • Advised a Malaysian company in a contractual dispute against a Vietnamese contractor before the Singapore International Arbitration Centre.
  • Represented a U.S. insurance company in pursuing storage damage claims of nearly USD 4 million against Vietnamese companies before a local Vietnamese court.
  • Assisted an Indian IT company in successfully negotiating a settlement with a Vietnamese bank in a USD 10 million contract dispute related to the client’s provision of licensed banking software and related support services.
  • Represented a Malaysian company in the oil and gas sector in an arbitration case before the Vietnam International Arbitration Centre (VIAC) related to performance of contract in a well plugging and abandonment project.
  • Represented foreign companies in getting foreign arbitral awards of SIAC, ICC, and ICA, and foreign court judgment recognized and enforced in Vietnam.
  • Advised and assisted a Chinese state-owned company in a construction dispute with a total value of dispute more than USD 9 million before VIAC.

Is arbitration only as good as the arbitrator? Undoubtedly. Choosing an arbitrator is therefore one of the most pivotal decisions a party makes in the arbitration proceedings. In practice in Vietnam, many arbitration proceedings have been significantly prolonged because of multiple unsuccessful appointments arising from conflicts of interest, challenges by the opposing party, or subsequent unavailability. In other cases, additional expenses were incurred where appointed arbitrators were located far from the hearing venue or were unfamiliar with the arbitration language or applicable law. To preempt these issues and secure a more efficient and cost-effective appointment, this article proposes a practical, step-by-step approach to arbitrator selection. Step 1: Know Your Own Case At the outset, it is essential to develop a clear understanding of the dispute by addressing the following key considerations: Nature of the dispute: From which sector does it arise (e.g., construction, international trade, investment, banking and finance, technology, intellectual property)? Value and complexity: Is the dispute high or low in value? Does it involve multiple parties, multiple legal systems, or foreign elements? Is its crux related to multiple legal matters? Existing arbitration agreement: Does the agreement specify the seat, language, and governing law? If not, what would be appropriate considering the parties’ conduct and the applicable arbitration rules? Having clear answers to these questions in mind will help identify, from the outset, the core criteria for selecting an appropriate arbitrator.
