PLC Distribution and Marketing of Drugs 2018 – Vietnam Chapter

Practical Law has published the 2018 edition of its Distribution and Marketing of Drugs Global Guide, a easily accessible Q&A overview of the key legal issues involved in bringing drugs to market in 29 jurisdictions worldwide. Members of the Tilleke & Gibbins life sciences team wrote the Vietnam chapter of this year’s guide.

The Vietnam chapter provides a high-level overview of the regulatory regime for the distribution and marketing of pharmaceuticals in Vietnam. The distribution section of the guide covers pre-conditions for distribution, including marketing authorization and exceptions; licensing; distribution to consumers; and wholesale distribution. The marketing section summarizes the regulations on marketing to consumers and marketing to professionals, including the types of marketing activities that are permitted and prohibited; restrictions on advertising; and the permissibility of discounts, free samples, and sponsorships.

With the official implementation of the ASEAN Free Trade Agreement effective on January 1, 2010, companies now have an expanded opportunity to increase exports in this important and diverse market. In regard to food, however, it should be noted that companies are still required to register their products with the local Food Agencies. Even though harmonization of rules for food products is a stated aim of ASEAN members—similar to the ASEAN Harmonization on Pharmaceutical Registration already in place for pharmaceutical products—harmonized rules have not yet been implemented in this area.

Foreign agrochemical companies usually opt to appoint their local distributors, agents, or licensees as the local entity to apply for and maintain product registration and import licenses as required by Asian Ministries of Agriculture. Such appointments are normally set out in the distribution agreement. While on most occasions this is a mutually beneficial relationship, sometimes local partners who have built up the business for those products may begin to compete unfairly or commit other breaches.

Under new Food and Drug Administration requirements, certain cosmetic products may need to be reclassified and re-registered. Previously, there had been three categories of cosmetics: general cosmetics, controlled cosmetics, and specially controlled cosmetics. Under the ASEAN Harmonized Cosmetic Regulation Scheme, all cosmetic products will need to be registered with the Thai FDA within the controlled cosmetics category, and the other two categories will be eliminated.

Circular 22/2009/TT-BYT issued by the Ministry of Health, effective May 24, 2010, has clarified certain issues related to intellectual property rights and drug marketing approval in Vietnam. The Circular emphasizes that the applicant for marketing approval for a drug shall be responsible for any infringement of IPRs used on or in relation to the drug. Consequently, proof of IP cleanness for a drug, such as search reports, registration certificates, or application acceptance decisions, is no longer required by the Drug Administration of Vietnam for obtaining drug marketing approvals.
