PLC Distribution and Marketing of Drugs 2018 – Vietnam Chapter

Practical Law Company

Practical Law has published the 2018 edition of its Distribution and Marketing of Drugs Global Guide, a easily accessible Q&A overview of the key legal issues involved in bringing drugs to market in 29 jurisdictions worldwide. Members of the Tilleke & Gibbins life sciences team wrote the Vietnam chapter of this year’s guide.

The Vietnam chapter provides a high-level overview of the regulatory regime for the distribution and marketing of pharmaceuticals in Vietnam. The distribution section of the guide covers pre-conditions for distribution, including marketing authorization and exceptions; licensing; distribution to consumers; and wholesale distribution. The marketing section summarizes the regulations on marketing to consumers and marketing to professionals, including the types of marketing activities that are permitted and prohibited; restrictions on advertising; and the permissibility of discounts, free samples, and sponsorships.

Tilleke & Gibbins also contributed the Thailand chapter of the guide. To read the Vietnam chapter, please click on the link below.

Recent years have witnessed a proliferation in the number of products available under the “nutritional food” heading. For companies to stand out from their competitors in this growing sector, marketing and advertising is integral for success. The ability to make claims regarding products is a significant aspect of this process. While the number of products has been on the rise, there has also been an augmentation in demand among consumers for healthier, more nutritious products. This, coupled with more aggressive advertising tactics, could lead to exaggerated or egregious claims.

As most ASEAN Food and Drug Administrations and Ministries of Agriculture labor under critical backlogs of product registration applications for the growing number of products being released into Asian markets, businesses are looking to new ways to facilitate approvals. Outsourcing product registration work to law firms is becoming an increasingly popular way for regulatory affairs departments to speed up applications as local knowledge and effective navigation go a long way in Asia.

Recent scandals, particularly the one involving melamine-tainted milk from China, have impacted consumer awareness in a big way, making consumers pay more attention to the quality and safety of the products they purchase. This is particularly true for products that are ingested, such as food and beverages. In Thailand, these products must first receive approval from the Food and Drug Administration in the case of food and drugs, and the Excise Department in the case of alcoholic beverages, before launching in the market.

Recently, the members of Association of Southeast Asian Nations (ASEAN) attempted to improve product registration efficiency and marketing approval for pharmaceutical products. The ASEAN harmonization regime hopes to improve the standard of the Food and Drug Administrations’ (FDAs) regulatory reviews in ASEAN countries. Despite these efforts, however, the lingering obstacle of a lack of intellectual property understanding continues to leave pharmaceutical companies with difficulties when dealing with product registration in several ASEAN FDAs.
