Biography

Suvijak Sriphavatsarakom is an associate in Tilleke & Gibbins’ intellectual property department based in Bangkok. With extensive experience in all aspects of intellectual property protection, he advises both international and domestic clients on a wide range of intellectual property-related issues. Companies trust Suvijak to provide expert assistance in IP enforcement and litigation, including filing appeals with the Trademark Board, filing complaints at Thailand’s Intellectual Property and International Trade Court, and formulating legal strategies to protect clients’ intellectual property rights. His services also include the filing, amendment, disclaimer, and renewal of trademark and patent applications.

Prior to joining Tilleke & Gibbins, Suvijak worked at other leading law firms and in the insurance industry. In addition to his intellectual property expertise, he has experience advising clients on compliance with Thailand’s Personal Data Protection Act, insurance law, and other corporate compliance matters.

Suvijak obtained his LLB from Assumption University. He is a member of the Lawyers Council of Thailand.

Experience

  • Assisted a leading telecommunications company in a copyright infringement case that specifically dealt with architectural work, involving preparing the necessary legal grounds for use during the appeal stage. The case was ultimately successful, and the court’s decision set a precedent that could be used as a reference in future cases.
  • Provided comprehensive advice and formulated a legal strategic plan to ensure that a patent security agreement complied with all relevant Thai laws and regulations, including review of the security agreement in line with all applicable laws.
  • Represented clients in managing and maintaining patent portfolios across multiple European countries, ensuring their patents were successfully maintained and protected.
  • Represented a leading university and construction company in Thailand in filing and prosecuting Patent Cooperation Treaty (PCT) applications across various fields of invention. This involved communication with the international search authorities in each country to ensure successful prosecution of the applications.
  • Assisted several clients in submitting reports to social media platforms regarding potential trademark infringement issues, resulting in removal of the infringing content.

Tilleke & Gibbins is proud to announce that four litigation cases handled by the firm have been selected among the nine Distinguished Judgment Awards granted by Thailand’s Central Intellectual Property and International Trade Court (IP&IT Court) for the period from October 1, 2024, to August 31, 2025. This recognition highlights the complexity, novelty, and legal significance of these cases, which were chosen based on stringent criteria including new legal issues, high evidentiary volume, and intricate legal arguments. Among these four cases, one was singled out as the “Most Distinguished Judgment” – the landmark trademark squatting case involving the trademark rights of our client, Thailand’s largest state-owned energy conglomerate, and its subsidiary. In this case, the defendants had filed 52 trademark applications mimicking our client’s marks, making it the largest trademark squatting dispute in Thai history. On April 30, 2025, the IP&IT Court ordered the cancellation of multiple infringing trademarks, setting a benchmark for IP enforcement against trademark squatters in Thailand. The other three recognized cases demonstrate Tilleke & Gibbins’ breadth of expertise in IP litigation: Patent infringement and invalidation involving trade secrets misappropriation. Trade dress infringement of a unique packaging. Landmark Luckin Coffee case involving trademark infringement and invalidation. The IP&IT Court handles approximately 200 IP civil litigation cases each year, and our IP litigation team has typically been involved in 25–30% of them, reflecting our dominant role in shaping IP jurisprudence in Thailand.
