Biography

Chandavya Ing is a senior associate in Tilleke & Gibbins’ Phnom Penh office. She advises intellectual property owners on a broad range of issues, including IP registration, IP commercialization, anticounterfeiting strategies, and enforcement actions. She has represented—including pro bono—a wide range of clients from the automotive, entertainment, fashion, food and beverage, and technology industries, among many others. She also deals with opposing parties and appears before the relevant authorities on behalf of clients during negotiations, opposition proceedings, mediation proceedings, and enforcement actions.

In addition to IP-related matters, Chandavya advises clients on regulatory affairs as well as telecommunications matters, tech-related matters, electronic commerce, and data privacy. With her valuable cross-practice expertise and insights, Chandavya guides companies of all sizes in protecting their business interests and achieving strategic gains in Cambodia.

Prior to rejoining Tilleke & Gibbins, Chandavya was a trademark and patent trainee at a market-leading firm in Germany, where she conducted research and prepared arguments in response to opposition before the European Union Intellectual Property Office.

Chandavya holds an LLM in Intellectual Property and Competition Law from the Munich Intellectual Property Law Center and earned her LLB from Cambodia’s Royal University of Law and Economics, where she now periodically provides lectures on intellectual property.

Chandavya is a trademark agent recognized by the Ministry of Commerce of Cambodia.

Experience

  • Represented clients in trademark matters before the Department of Intellectual Property Rights within Cambodia’s Ministry of Commerce. This includes filing trademark applications for registration, maintaining and defending trademark portfolios through recordal of changes/assignments, oppositions, cancellations, renewals, registration of license agreements, watch services, and other related actions.
  • Acted for multinational clients across their full range of needs relating to patents, utility models, and designs in Cambodia. This includes representing clients before the Department of Industrial Rights within Cambodia’s Ministry of Industry and Handicraft to file applications for registration, respond to office actions, record changes in application details, and pay annuities.
  • Advised a local company in the entertainment industry on its copyright-related agreements and reviewed the agreements, including a brand ambassadorship agreement, composer agreement, concert production agreement, performance agreement, and so on, in order to fit the client’s business objectives.
  • Advised and represented a manufacturer of electrical and electronic equipment at a hearing in mediation proceedings at Cambodia’s Department of Intellectual Property Rights on a dispute relating to the infringing use of the client’s trademark.
  • Advised and represented various clients from the automotive, fashion, food and beverage, electronics, and technology industries on enforcement actions, including negotiation, anticounterfeiting strategies, and raid actions, against unauthorized use and infringement of their rights.
  • Advised a Thai agricultural machinery company on regulatory and data protection aspects in relation to the launching of its agrotech product and related mobile application.
  • Assisted a beverage company in preparing and reviewing its master franchise agreement and recording the agreement with the Cambodia’s Department of Intellectual Property Rights.
  • Advised several local and overseas big tech companies on conducting business in Cambodia over the internet by providing guidance on requirements related to Cambodia’s E-commerce Law.
  • Advised clients on data protection, information and communications technology, and telecommunications matters.
  • Advised and assisted an airline company on the provision of in-flight connectivity from regulatory perspective.
  • Advised several tech companies on the legality of their planned ICT and telecommunications operations in Cambodia.

The General Department of Customs and Excise (GDCE) in Cambodia’s Ministry of Economy and Finance launched a trial phase of its Intellectual Property Rights Recordation System (IPRRS) on September 1, 2024. The system compiles necessary information and documents related to intellectual property rights in the country, enabling customs authorities to swiftly access these documents and enhance their ability to identify and intercept potential parallel imports and infringing goods at the border. This will also better facilitate ex-officio actions by customs authorities. The system is currently referred to as being in a “trial phase” to support further amendments or updates to address any potential technical errors that may arise from public use. However, the IPRRS is already fully operational. Types of Recordation Currently, the IPRRS allows two types of recordation: Intellectual property recordation is available for trademarks, geographical indications, copyrights, and related rights that are protected in Cambodia. It allows IP owners, authorized representatives, and legal representatives to record information and documents relating to such rights, including information on possible or potential counterfeit goods, with the GDCE. Recordation will give customs authorities quicker access to the information and enable them to promptly take action against potential counterfeit or infringing goods. Exclusive distributorship recordation is meant to streamline the process that takes place after the Ministry of Commerce issues a notice of the recordation of exclusive rights. Under the current practice, after receiving a copy of a notice of the recordal of an exclusive distributorship issued by the Ministry of Commerce (MOC), the GDCE needs to enter the information into their system manually to enable them to promptly identify or stop potential parallel importation at the border.
