Vietnam Drafts Amendment to Patent Examination Guidelines for Inventions Related to Computer Programs

To improve its patent application processing capacity, the Intellectual Property Office of Vietnam (IP Office), with the support of the Japan International Cooperation Agency (JICA), is continuing to develop a draft amendment to the patent application examination guidelines for inventions related to computer programs.

After issuing Annex I to the patent application examination guidelines in 2021, which covered subject-matters related to computer programs that are protected as inventions, the IP Office’s Patent Examination Center, with the support of experts from the JICA, has now developed a draft of Annex II. This draft provides guidance on examination related to a sufficient disclosure of the substance of claimed subject-matters and an assessment of the protection criteria (novelty and inventive step) of subject-matters related to computer programs, along with illustrative examples.

In addition, the draft introduces the concepts of “sub-combination inventions” and “mixed-type inventions”, an assessment of the clarity of sub-combination inventions, and the assessment of novelty and inventive step of mixed-type inventions.

To evaluate the amendments in the draft, in conformity with the legal regulations and the examination practice, the Patent Examination Center organized a discussion of the draft on February 4, 2023, with the contribution of opinions and comments from IP representatives, organizations, schools, institutes, and individuals. The Patent Examination Center announced that it wishes to receive further constructive opinions from interested parties to improve the amendments of the guidelines.

In the context that inventions related to computer programs are closely related to new technologies such as artificial intelligence (AI), and noting the many difficulties arising in the examination process, we hope that the amendments to the guidelines, specifically as outlined in the draft of Annex II, will soon be finalized and officially released. This annex will certainly facilitate the examination of inventions related to computer programs, as well as be a useful reference for applicants and inventors when establishing rights to inventions related to computer programs.

Navigating Document Formality Challenges in Vietnam

Intellectual property rights holders pursuing legal actions in Vietnam have faced various challenges related to document formality in recent years. For example, in two different disputes at the Ho Chi Minh City Court, we have seen the judge request the claimants to re-prepare the civil dossier due to a lack of documentation proving the authorization of the signer—despite the fact that the cases had been ongoing for long time. Meanwhile, many domain names have been unable to be registered and transferred in recent months. Third-party representatives cannot handle the work as they normally would, as Vietnam’s domain name authority has required all documents to be signed by the domain name holders themselves, instead of the law firms representing them. Such demands have created unnecessary complexities and obstacles for IP holders seeking to protect their rights in Vietnam. Legal Formalities in the Court System Vietnam’s judicial landscape presents unique hurdles for IP holders to enforce their rights. One significant challenge is the requirement for the claimant’s legal representative (typically the CEO/president), as explicitly displayed on the company’s business license, to sign all documents related to a lawsuit. This requirement clashes with the operational practices of many foreign companies, where multiple individuals may have the authority to represent the company. It is extremely impractical, especially in a large multinational conglomerate, for the CEO/president to personally execute all documents and transactions. Instead, authorized staff within these organizations, such as department heads or general counsel, typically handle these tasks. In this situation, Vietnamese courts often demand additional documentation to prove the officers’ authority, necessitating specific authorization documents that may not always be readily available. Indonesia Requires Textile and Footwear Importers to Submit Trademark Certificates

Indonesia’s Ministry of Industry (MOI) has issued a new regulation requiring importers of textiles, textile products, bags, and footwear to furnish applicable trademark certificates when applying for an import permit. This means that a letter of appointment to import from the trademark owner or authorized representative is no longer sufficient to obtain an import permit for these goods. The requirement is detailed in MOI Regulation No. 5 of 2024 concerning Procedures for Issuing Technical Considerations for Imports of Textiles, Textile Products, Bags and Footwear, which took effect on March 10, 2024. Affected Products The new regulation applies to the following products: Textiles: Fiber, thread, fabric Textile products: Carpets, other textile floor coverings, clothing, ready-made clothing accessories, other finished textile goods Bags: Suitcases, wallets, school bags, sports bags, handbags, other bags Footwear: Shoes, sandals, moccasins Import Permits In principle, businesses can import textiles, textile products, bags, and footwear as raw materials, auxiliary materials, or consumer goods (for trading) after obtaining the appropriate import permit from the Ministry of Trade (MOT). There are three categories of import permits: General import permits for consumption (API-U), which are required for parties that conduct import activities for the purpose of trading; Import permits for producers (API-P); and Import permits for suppliers of raw or auxiliary materials (PPBB). Applicants for an import permit must submit an application for general importer verification (VIU), the results of which will inform the MOI’s technical consideration process. If the MOI issues a recommendation or approval based on their technical consideration, applicants will be able to proceed with the submission of their import permit to the MOT.
