Tilleke & Gibbins’ Vietnam Trademark Practice Ranked in “Tier 1” by Asia IP

Hong Kong-based legal magazine Asia IP  has ranked Tilleke & Gibbins’ trademark practice in Vietnam in “Tier 1” for “Trademark Prosecution” and “Trademark Contentious” work. The rankings were included in the magazine’s Trademark Survey 2015. Tilleke & Gibbins also placed in the top tier in Thailand.

In the editorial accompanying the ranking, Tilleke & Gibbins’ precedent-setting victory for Videojet Technologies Inc., which was selected as Managing Intellectual Property’s Case of the Year for Southeast Asia for 2014, was highlighted for its significance—the Ho Chi Minh City Court awarded the full amount of damages that Videojet sought, and an additional USD 10,000 in attorney’s fees, which is believed to be the highest award ever given in Vietnam. In addition to the record award, the case showed that a civil action can follow administrative actions, and IP holders in Vietnam are not limited to pursuing a single avenue of recourse.

In addition, Linh Thi Mai Nguyen, at attorney-at-law in Tilleke & Gibbins’ Hanoi office, was cited for her opinion on the two greatest imperatives for trademark owners in Vietnam: “The first is to protect their trademark rights from infringement and bad-faith filings,” she said. “And the other is to prove that their marks are sufficiently well-known.”
