Tilleke & Gibbins Promotes Three New Partners in Thailand and Vietnam

Tilleke & Gibbins is pleased to announce the promotion of three partners to our firm’s partnership, effective January 2019:

John Frangos focuses on complex disputes across Southeast Asia from the firm’s head office in Bangkok. With over a decade of experience in Thailand and Vietnam, John’s strong knowledge of local business practices and customs, and his deep understanding of the region’s political and economic landscapes, help him to guide foreign investors through the legal environments in which they operate. John assists clients with the full range of cross-border commercial disputes, liability claims, high-stakes white-collar criminal matters, and international arbitration. He leads the firm’s regional aviation disputes practice, acting for airlines, lessors, and other aviation industry leaders. He also co-heads Tilleke & Gibbins’ regional compliance and investigations practice, handling anti-corruption and regulatory investigations and advising on corporate compliance programs.

Linh Thi Mai Nguyen is based in the firm’s Hanoi office, and heads the Tilleke & Gibbins trademark team in Vietnam. She is recognized as a leading trademark attorney by the WTR 1000, an “IP Star” by Managing Intellectual Property, and a “Rising Star” by Euromoney with multiple nominations at the annual Asia Women in Business Law Awards. Linh brings an encyclopedic and practical understanding of Vietnamese IP law to the partnership, both from a lawyer’s perspective and from the viewpoint of Vietnam’s legislators and judiciary, drawing on more than a decade of experience as a trusted IP counsel to owners of world-famous brands, and five years as a legal program officer with the USAID-funded STAR project, where she coordinated with government agencies to ensure that Vietnam’s legal regime complied with international commitments.

Wiramrudee (Pink) Mokkhavesa is an attorney in the firm’s regional intellectual property practice, based in Bangkok, who is well regarded for her extensive experience in brand protection, IP enforcement, and anticounterfeiting. Her practice is focused on IP portfolio strategy and management, including registration, commercialization, and protection of trademark, copyright, patent, and other intellectual assets in Asia and worldwide, from the administrative level up to the higher courts. She primarily represents multinational corporations and market leaders in the apparel and luxury goods, automotive parts, consumer products, and software industries. Pink is also well known regionally and internationally for her tireless work to raise public awareness of counterfeiting, through her leadership roles in organizations such as INTA, her strong working relationship with national government agencies in Thailand, and her regular appearances in domestic and international media.

Commenting on the appointments, Darani Vachanavuttivong, Co-Managing Partner and head of the firm’s IP practice, noted that “these exceptionally talented professionals have played an integral role in the growth of our practices, and our reputation for excellent client service, across Southeast Asia, and they are an outstanding addition to the partnership of our firm.”

On April 8, Tilleke & Gibbins took part in a webinar titled “Be Ready for the Thai PDPA,” cohosted by Cisco Systems. This virtual event aimed to assist businesses in preparing for enforcement of Thailand’s Personal Data Protection Act (PDPA), which is set to take full effect in June 2022. In a presentation titled “Timeline, Regulations, and What’s to Come,” Nopparat Lalitkomon, a senior associate in the firm’s corporate and commercial group in Bangkok, outlined the key principles of the PDPA, considered the overall readiness of the country’s business community, and highlighted necessary steps that companies active in Thailand should take immediately as the law’s effective date draws closer. Nopparat concluded the session with practical advice to assist companies to manage their internal systems effectively to comply with the PDPA when it comes into force in June.

Tiziana Sucharitkul, managing partner and director of Tilleke & Gibbins’ dispute resolution group, provided in-depth insights on diversity and inclusion and law firms for a recent article in Asia Business Law Journal (ABLJ) on diversity and inclusion in law firms across Asia. In the article, which was published on March 30, 2022, Tiziana offers insights gained in her years in senior leadership at Tilleke & Gibbins and as a longtime advocate for law firm diversity and inclusion initiatives. The article begins by contrasting the demand for greater diversity among Western law firms—especially by corporate counsel—with attitudes in Asia, where questions of expertise and service often take precedence when it comes to legal work. The writer then quickly shifts to investigating the reasons for this, as well as exploring the current state of diversity in the Asian legal industry today. This section of the article leads with Tiziana’s explanation that leadership of Asian law firms are in a very different context than the social tensions that catalyzed many diversity initiatives in the West. However, this does not necessarily mean that diverse representation has lagged in this part of the world. Rather, as Tiziana points out, “Southeast Asian countries have some of the highest proportions of women in senior business leadership in the world.” She also notes that markers such as gender diversity and respect for minority rights can vary widely across Asia. Elsewhere in the article, other senior law firm leaders express similar observations and provide details on the diversity challenges in their countries of focus. For example, an expert on diversity in the Indian legal profession notes that local diversity concerns must also consider caste discrimination, and a partner at a global firm in Singapore speaks about the challenges of developing diversity policies that fit each local context. At the annual general meeting of the Inter-Pacific Bar Association (IPBA) on March 24, Pimvimol (June) Vipamaneerut, a partner in the firm’s corporate and commercial group in Bangkok, was elected as IPBA’s jurisdictional committee member for Thailand. In the role, Pimvimol will be responsible for membership issues in Thailand, and will be the key point of contact for matters concerning activities in the jurisdiction. She will serve as Thailand’s jurisdictional committee member for three years (2022–2025). The IPBA is a prestigious international association of business and commercial attorneys active or with a strong interest in the Pacific region. The IPBA has a membership of more than 1,500 legal professionals from over 65 countries and jurisdictions. Through its activities, the IPBA provides lawyers interested in the Asia-Pacific with opportunities to discuss legal, business, and policy issues affecting the region and grow in their legal practice through professional networking. On March 29, Tilleke & Gibbins collaborated with True Digital Park (TDPK) to offer a webinar on online gaming regulations in Thailand. In the webinar, Nopparat Lalitkomon, senior associate, and Gvavalin Mahakunkitchareon, associate, both the firm’s corporate and commercial group, were guest speakers jointly addressing a number of topics related to online gaming in Thailand, including: An overview of current laws and regulations on online gaming in Thailand; Recent and potential regulatory developments; Strategies for compliance with Thailand’s regulatory regime for online gaming; and Enforcement trends in Thailand. With the rising popularity of the online gaming industry, companies need to understand the regulatory framework fully before making any significant investment.
