Tilleke & Gibbins Promotes Three New Partners in Thailand and Vietnam

Tilleke & Gibbins is pleased to announce the promotion of three partners to our firm’s partnership, effective January 2019:

John Frangos focuses on complex disputes across Southeast Asia from the firm’s head office in Bangkok. With over a decade of experience in Thailand and Vietnam, John’s strong knowledge of local business practices and customs, and his deep understanding of the region’s political and economic landscapes, help him to guide foreign investors through the legal environments in which they operate. John assists clients with the full range of cross-border commercial disputes, liability claims, high-stakes white-collar criminal matters, and international arbitration. He leads the firm’s regional aviation disputes practice, acting for airlines, lessors, and other aviation industry leaders. He also co-heads Tilleke & Gibbins’ regional compliance and investigations practice, handling anti-corruption and regulatory investigations and advising on corporate compliance programs.

Linh Thi Mai Nguyen is based in the firm’s Hanoi office, and heads the Tilleke & Gibbins trademark team in Vietnam. She is recognized as a leading trademark attorney by the WTR 1000, an “IP Star” by Managing Intellectual Property, and a “Rising Star” by Euromoney with multiple nominations at the annual Asia Women in Business Law Awards. Linh brings an encyclopedic and practical understanding of Vietnamese IP law to the partnership, both from a lawyer’s perspective and from the viewpoint of Vietnam’s legislators and judiciary, drawing on more than a decade of experience as a trusted IP counsel to owners of world-famous brands, and five years as a legal program officer with the USAID-funded STAR project, where she coordinated with government agencies to ensure that Vietnam’s legal regime complied with international commitments.

Wiramrudee (Pink) Mokkhavesa is an attorney in the firm’s regional intellectual property practice, based in Bangkok, who is well regarded for her extensive experience in brand protection, IP enforcement, and anticounterfeiting. Her practice is focused on IP portfolio strategy and management, including registration, commercialization, and protection of trademark, copyright, patent, and other intellectual assets in Asia and worldwide, from the administrative level up to the higher courts. She primarily represents multinational corporations and market leaders in the apparel and luxury goods, automotive parts, consumer products, and software industries. Pink is also well known regionally and internationally for her tireless work to raise public awareness of counterfeiting, through her leadership roles in organizations such as INTA, her strong working relationship with national government agencies in Thailand, and her regular appearances in domestic and international media.

Commenting on the appointments, Darani Vachanavuttivong, Co-Managing Partner and head of the firm’s IP practice, noted that “these exceptionally talented professionals have played an integral role in the growth of our practices, and our reputation for excellent client service, across Southeast Asia, and they are an outstanding addition to the partnership of our firm.”

Michael Ramirez, a counsel in Tilleke & Gibbins’ dispute resolution group in Bangkok, will provide the Thailand legal outlook at a Thailand Regional Forum meeting to be held at Sasin School of Management on June 9, 2022. The event will be a special relaunch meeting of the Thailand Regional Forum, an initiative established by Dataconsult some 35 years ago. After a hiatus during the COVID-19 pandemic, the forum is restarting with Sasin School of Management as its new home. The Thailand Regional Forum at Sasin plans to hold regular meetings from July onward. The meeting will consist of forecasting panel presentations and roundtable discussions. In addition to Michael’s presentation of the legal outlook for Thailand, other speakers will offer insights into Thailand’s political, risk, economic, and human resources outlook in the coming year. Following the presentations, the speakers and attendees will participate in a roundtable discussions and Q&A to address any questions that came up during the session and to consider various potential scenarios. On May 24, 2022, Tilleke & Gibbins was joined by the British Chamber of Commerce Thailand (BCCT) in holding an event entitled “7-Day Countdown: What to Know about Personal Data Protection Act Enforcement” at the Conrad Bangkok hotel. The event aimed to equip the British business community in Thailand with essential knowledge to be fully compliant with the law. During the event,  Nopparat Lalitkomon, senior associate, and Gvavalin Mahakunkitchareon, associate, walked attendees through the following key considerations: Roles and responsibilities of data controllers and data processors; Management of personal data collected prior to the effective date of the PDPA; and Practical advice to avoid potential pitfalls. The event concluded with a networking reception in which participants had an opportunity to connect and discuss further details with the firm’s PDPA experts.

On April 20, three attorneys from Tilleke & Gibbins’ corporate and commercial group—Gvavalin Mahakunkitchareon, associate; Nopparat Lalitkomon, senior associate; and Pongpalin Chantrapirom, associate—offered a Thai-language webinar entitled “Personal Data Protection Compliance Preparation.” During the session, the three speakers gave a comprehensive overview of Thailand’s data protection regulatory regime to assist attendees in complying with the Personal Data Protection Act BE 2562 (PDPA), which will come into full effect on June 1, 2022. In particular, the speakers covered the following topics: Key principles of personal data collection; PDPA compliance considerations for insurance companies; Notification of data collection and data processing in accordance with the law; Managing personal data collected prior to the effective date of the PDPA; Penalties for noncompliance with the PDPA; and Comparative case studies involving the EU’s GDPR (General Data Protection Regulation). On April 8, Nopparat Lalitkomon, senior associate in the firm’s corporate and commercial group in Bangkok, took part in a webinar titled “Be Ready for Thai PDPA,” cohosted by Cisco Systems. The virtual event aimed to assist businesses in preparing for enforcement of Thailand’s Personal Data Protection Act (PDPA), which takes full effect on June 1, 2022. In his presentation, which was titled, “Get Ready for PDPA: Timeline, Regulations and What’s to Come,” Nopparat outlined the key principles of the PDPA and its related regulations, and highlighted necessary steps that Thai companies need to take as the deadline draws closer. At the conclusion of the session, He provided attendees with practical advice they can use to help their companies effectively manage their internal system to comply with the PDPA in June.
