Tilleke & Gibbins Promotes Three New Partners in Thailand and Vietnam

Tilleke & Gibbins is pleased to announce the promotion of three partners to our firm’s partnership, effective January 2019:

John Frangos focuses on complex disputes across Southeast Asia from the firm’s head office in Bangkok. With over a decade of experience in Thailand and Vietnam, John’s strong knowledge of local business practices and customs, and his deep understanding of the region’s political and economic landscapes, help him to guide foreign investors through the legal environments in which they operate. John assists clients with the full range of cross-border commercial disputes, liability claims, high-stakes white-collar criminal matters, and international arbitration. He leads the firm’s regional aviation disputes practice, acting for airlines, lessors, and other aviation industry leaders. He also co-heads Tilleke & Gibbins’ regional compliance and investigations practice, handling anti-corruption and regulatory investigations and advising on corporate compliance programs.

Linh Thi Mai Nguyen is based in the firm’s Hanoi office, and heads the Tilleke & Gibbins trademark team in Vietnam. She is recognized as a leading trademark attorney by the WTR 1000, an “IP Star” by Managing Intellectual Property, and a “Rising Star” by Euromoney with multiple nominations at the annual Asia Women in Business Law Awards. Linh brings an encyclopedic and practical understanding of Vietnamese IP law to the partnership, both from a lawyer’s perspective and from the viewpoint of Vietnam’s legislators and judiciary, drawing on more than a decade of experience as a trusted IP counsel to owners of world-famous brands, and five years as a legal program officer with the USAID-funded STAR project, where she coordinated with government agencies to ensure that Vietnam’s legal regime complied with international commitments.

Wiramrudee (Pink) Mokkhavesa is an attorney in the firm’s regional intellectual property practice, based in Bangkok, who is well regarded for her extensive experience in brand protection, IP enforcement, and anticounterfeiting. Her practice is focused on IP portfolio strategy and management, including registration, commercialization, and protection of trademark, copyright, patent, and other intellectual assets in Asia and worldwide, from the administrative level up to the higher courts. She primarily represents multinational corporations and market leaders in the apparel and luxury goods, automotive parts, consumer products, and software industries. Pink is also well known regionally and internationally for her tireless work to raise public awareness of counterfeiting, through her leadership roles in organizations such as INTA, her strong working relationship with national government agencies in Thailand, and her regular appearances in domestic and international media.

Commenting on the appointments, Darani Vachanavuttivong, Co-Managing Partner and head of the firm’s IP practice, noted that “these exceptionally talented professionals have played an integral role in the growth of our practices, and our reputation for excellent client service, across Southeast Asia, and they are an outstanding addition to the partnership of our firm.”

Thomas J. Treutler, partner and managing director of Tilleke & Gibbins’ Vietnam offices, was interviewed for an Asia IP article on the growing use of artificial intelligence (AI) in the realm intellectual property enforcement. The provocatively titled “Will AI bring the death of IP enforcement work?” explores the impact of AI in the IP space, and the delicate balance between helping and replacing IP professionals. In the article, Thomas is quoted as saying that “AI-powered algorithms can be trained to detect and monitor IP infringements more rapidly than a single human can, as they are able to analyze vast amounts of data on online platforms, social media and ecommerce marketplaces. This can preliminarily help rights owners and IP agents in data scraping to identify potential targets.” However, he further explained, “taking legal action requires human actions; for example, filing a complaint with the police or handling litigation proceedings in court. Athistha (Nop) Chitranukroh, partner and director of Tilleke & Gibbins’ corporate and commercial group, is quoted extensively in a recent article on fintech in Southeast Asia. The article, which was published in the August 2023 issue of Asian Legal Business, highlights the importance of achieving a balance between innovation and regulation in fostering a healthy environment for fintech operations. In the article, Nop emphasizes that innovation and regulation should not be seen as competing ideals. “When it comes to new and complex products in the fintech sector,” she says, “a clear and comprehensive regulatory framework can give businesses the confidence to make investments.” Nop also points out the role of regulations and regulators in combating cybercrime within the fintech realm, noting that regulators are a crucial ally in the fight against cyber threats. She explains that this can even be on a regional or global level. For example, the Financial Action Task Force and its recommendations create a network that has been especially effective in combating cross-border financial crimes. Athistha (Nop) Chitranukroh, partner and director of Tilleke & Gibbins’ corporate and commercial group, was quoted in a recent article from the Financial Times on how law firms are helping clients tackle cybersecurity risks and navigate fast-evolving regulatory landscapes for data protection and cybersecurity in Asia. In the article, Nop commented on recent Thai legislation that requires companies monitoring the behavior of residents to have a local data privacy representative in the country. She explained that this has created a client-service opportunity for Tilleke & Gibbins, which set up a digital solutions service that allows the firm to be the representative in Thailand for existing clients, including Meta Platforms, the owner of Facebook. This helps clients become compliant and avoid having to set up their own local representative in Thailand. Nop also discussed enforcement of the country’s fledgling Personal Data Protection Act and related regulations. “Last year, when the law was implemented, the regulator’s approach was more educational,” she told Financial Times. “This year, I would expect the regulator to start imposing fines. Dino Santaniello, head of Tilleke & Gibbins in Laos, and Naiyane Xaechao, a paralegal in the Vientiane office, recently met with officials from the Department of Cybersecurity in Laos’ Ministry of Technology and Communications, as well as representatives from the European Chamber of Commerce and Industry in Laos (ECCIL), to discuss a white paper drafted by the firm regarding the Law on Electronic Data Protection. The aim of the meeting was to provide recommendations for amending the law to comply with international standards on data privacy while also taking into account the unique needs of Laos. During the discussion, Dino and Naiyane shared their deep knowledge and expertise in the field of data protection as they addressed various questions raised by the officers and ECCIL representatives. The meeting showcased Tilleke & Gibbins’ commitment to staying up-to-date on legal developments and working closely with government officials to ensure that laws are fair and effective for all stakeholders.
