Regional Southeast Asian law firm Tilleke & Gibbins is pleased to announce the promotion of two exceptional lawyers to the firm’s partnership, effective January 2023.

Chuyen Hong Huu Le  is based in Tilleke & Gibbins’ Ho Chi Minh City office, where she is a trusted commercial adviser to some of the most prominent international companies doing business in Southeast Asia—particularly in the aviation, life sciences, and hospitality sectors. A seasoned and practical corporate attorney with a wide range of expertise, Chuyen is particularly adept at matters relating to foreign investment and market entry, labor and employment, commercial transactions and M&A, compliance and investigations, anti-bribery and anti-corruption, and antitrust and competition. Chuyen has particular expertise in the healthcare sector (including pharmaceuticals, medtech and consumer health), where she has advised many top multinational companies on doing business in Vietnam. She also has extensive experience in the aviation sector, and assists clients with aircraft leasing/financing, aircraft-related interest registrations, and repossession. Chuyen is a Certified Compliance and Ethics Professional – International (CCEP-I) and is regularly engaged by companies to conduct compliance investigations and audits, as well as to provide compliance training sessions for staff and business partners. She has also built extensive in-house experience through secondments as chief legal counsel in Vietnam for the world’s largest three-sector healthcare company, and as an in-house counsel for Vietnam at a world-leading medical device company operating in orthodontics. In 2021, Chuyen was recognized in Euromoney’s Rising Stars Awards Asia-Pacific.

Noppramart Thammateeradaycho  is an experienced Thai litigator with over 20 years’ experience of trial and appellate advocacy at all levels of the Thai courts, and of international arbitration including cases in Australia, Cambodia, Indonesia, Laos, Myanmar, and Singapore. She is particularly sought after for her experience in arbitration and is known for her skilled navigation of both international rules (particularly UNCITRAL, SIAC, ICC, HKIAC, and GAFTA rules) and domestic rules, including those of the Indonesian National Arbitration Institute (BANI), NCAC (Cambodia), Thai Arbitration Institute (TAI), and Thailand Arbitration Center (THAC). Her practice covers various industries, including construction, insurance and reinsurance, telecommunication, and media and technology. Noppramart also has extensive experience in handling complex commercial arbitrations and she has acted as arbitrator and arbitration counsel in multijurisdictional matters in international Joint-Venture, shareholders, construction, maritime and investment disputes. She is a court member of the ICC International Court of Arbitration; a member of the international arbitrator panels of several arbitral institutes including the TAI, the Shanghai Arbitration Commission (SHAC), and the Shenzhen Court of International Arbitration (SCIA); and is an accredited mediator of the Singapore International Mediation Institute (SIMI). Noppramart is a former vice-chair of the Thailand branch of the Chartered Institute of Arbitrators, and serves as an honorary faculty member of the Asian International Arbitration Centre’s AIAC Academy.

On February 26, 2021, Yuwadee Thean-ngarm was the moderator for a finance- and technology-focused online discussion on the current situation in Myanmar, organized by the Thai Business Association (TBAM). She was joined by three distinguished panelists: Chana Sindhvananda, minister counsellor from the Royal Thai Embassy in Yangon; Nuttaphong Visitkitchakarn, chief representative from Kasikornbank PCL’s Yangon office; and Passakorn Hongsyok, general manager of Myanmar Information Highway Ltd. A recent article on the progress of the business rehabilitation of Thai Airways quotes John Frangos, partner and deputy director of Tilleke & Gibbins’ dispute resolution department, on various aspects of the developing case. The article, titled “Lessors strike deals with Thai Airways,” was written by airline industry business information provider Cirium and shared through FlightGlobal, the world’s leading publisher of news, analysis, and other content for the aviation industry. The article reports that the majority of the aircraft lessors who have exposure to Thai Airways are in the final stages of signing agreements with the beleaguered airline to govern management of their aircraft in the business restructuring process. In discussing his own experience representing various creditors in the process, John explains that the airline may be adopting a blanket policy of objecting to requests for debt repayment. “It appears to be a clear strategy of the plan preparer to object to many debt-repayment applications as a way to try to reduce the overall debt amount,” he is quoted as saying. The article also notes that there is still considerable uncertainty surrounding the ongoing business rehabilitation. Part of this is related to the future makeup of the carrier’s reduced fleet, but the most pressing issue is whether Thai Airways will submit its rehabilitation plan by the March 2, 2021, deadline. If this deadline is not met, one possibility is that the airline would have to file for dissolution. However, John considers that even if they miss the deadline, other workarounds will be explored. “If they don’t finish and they do legitimately need more time, then at least for me personally I can’t see the whole process unravelling because they can’t submit by the deadline,” he says. In response to this, the governments of Cambodia, Laos, and Myanmar have taken great steps in recent years to protect these valuable commercial assets, strengthen IP laws, and build robust legal regimes for the registration, protection, and enforcement of IP rights. Although these legal frameworks are still developing, the current measures available are sufficient for many savvy companies to register and protect their IP rights and prevent the spread of harmful counterfeit products.
