Tilleke & Gibbins 2022 Annual Employment Law Forum: English-Language Sessions

Tilleke & Gibbins’ regional employment team presented two sessions on employment law issues in Southeast Asia as part of the 2022 Annual Employment Law Forum.

On November 29, the forum featured a session titled “Poor Performance Terminations in Cambodia, Laos, Myanmar, Thailand, and Vietnam,” with presentations by Dino Santaniello (Laos), Nitikar Nith (Cambodia), Pimvimol Vipamaneerut (Thailand), Sarah Galeski (Vietnam), and Yuwadee Thean-ngarm (Myanmar).

On November 30, Chitchai Punsan highlighted criminal proceedings relating to Thailand’s Labour Protection Act B.E. 2541 (1998). The session covered potential responsible parties, different types of criminal offenses, and criminal proceedings.

On December 7, Suruswadee Jaimsuwan and Pathanin Sornchangwat concluded the final presentation of the webinar series with an English presentation titled, “Exploring Complex Procedural Laws in Labor Disputes: Class Actions and Arbitration.”

Tilleke & Gibbins’ Employment Law Forum is an annual event featuring insights on relevant laws and regulations for employers in Thailand and the region. The forum this year also featured several sessions in Thai.

On August 11, Atthachai Homhuan, director of Tilleke & Gibbins’ regulatory affairs department, delivered a webinar entitled “How to Export Cosmetics to Thailand.” Cohosted by Tilleke & Gibbins and ChemLinked, the webinar was designed to equip international cosmetics producers and exporters with a fundamental understanding of the cosmetics regulatory framework in Thailand and related compliance requirements. During the session, Atthachai provided an in-depth overview of laws relating to cosmetics businesses in Thailand and shared examples of his hands-on experience assisting cosmetics industry clients with key regulatory compliance matters in the jurisdiction. Among other things, this included: An overview of the importation process for cosmetics products in Thailand; A discussion on product name and advertisement controls in the country; and Practical advice on how cosmetics companies can comply with local regulations. On August 12, Jay Cohen, partner and director of Tilleke & Gibbins’ office in Phnom Penh, spoke on recent legal developments in Cambodia in a webinar hosted by the American Chamber of Commerce. Titled “Cambodia’s Investment Law 2021,” the webinar focused on the country’s new draft Investment Law, which was unveiled in July 2021. The law encourages greater investment in Cambodia by aiming to increase the competitiveness and productivity of local industry, offering investment incentives, protecting investors’ rights and interests, and improving Cambodia’s ability to plug into regional and global supply chains. During the session, Jay and the other panelists discussed: The development of investment legislation in Cambodia; The anticipated impact of the Cambodian’s draft Investment Law; and Implications of the draft law for investors and the larger business community in Cambodia. During the concise yet informative session titled “Introduction to Guaranteed Rental Returns in Cambodia,” Jay discusses: The definition of a GRR scheme under Cambodian law, including an overview of certain benefits for investors; Key considerations investors should understand before entering into a GRR agreement; The possibility of changing GRR contract terms during force majeure events; and What happens when the GRR period ends.
