The PLC Energy and Natural Resources Global Guide 2016/17  provides an overview of electricity laws and regulations in jurisdictions around the world, structured in a Q&A format. Vinh Quoc Nguyen, a senior attorney-at-law in Tilleke & Gibbins’ Ho Chi Minh City office, authored the Vietnam chapter of the electricity guide.

The Vietnam chapter covers recent trends including the prevalence of build-operate-transfer projects, regulations such as the Electricity Law of 2004 and the role of Vietnam Electricity, foreign ownership of electricity companies and assets, government policies and incentives including zero import duty for assets which form the fixed assets of a renewable energy project, authorization and operating requirements, and electricity transmission, distribution, and supply. The chapter also discusses tax issues and proposals for reform including the liberalization of Vietnam’s electricity market.

The Ministry of Energy has issued an order to delay the 23rd round of bidding for petroleum exploration and production, as reported on the official website of the Department of Mineral Fuels (DMF). The 23rd round of bidding involved three exploration blocks in the Gulf of Thailand, and was previously expected to open in early April 2020, with the DMF set to return their final decision regarding concessions within the end of 2020. The delayed round of bidding would have reportedly been the first round in 13 years.

On March 2, 2020, the Department of Mineral Fuels (DMF) issued Notification Re: the Determination of Exploration Blocks for the Bidding for Petroleum Exploration and Production Concessions B.E. 2563 (2020). This notification, which repeals Notification of the Department of Mineral Fuels Re: the Determination of Exploration Blocks for the Bidding for Petroleum Exploration and Production Concessions B.E. 2561 (2018), allocates the areas to be used as exploration blocks for the 23rd round of bidding for petroleum and exploration production concessions.
