The Nation Quotes David Lyman on Thailand’s Corruption Challenges Ahead of AEC Integration

The Nation

Corruption continues to negatively affect Thailand’s competitiveness due to a lack of political will to tackle the problem, according to David Lyman, Chairman & Chief Values Officer of Tilleke & Gibbins, in a statement published in today’s edition of The Nation. David also emphasized the importance of continuity and stability in Thailand’s investment policies, especially in the context of the upcoming ASEAN Economic Community (AEC).

David made these remarks as part of his participation in the seminar “2012 Thailand Investment Environment: Maximizing the AEC Opportunity,” organized by the Joint Standing Committee on Commerce, Industry, and Banking (JSCCIB) – Thailand, with cooperation from the foreign chambers of commerce in Thailand. The event was held at Mahisorn Hall, SCB Park Plaza, Bangkok, on August 15, 2012.

David was a panelist in a discussion about how to improve Thailand’s progress in anti-corruption measures ahead of AEC integration in 2015. Moderated by Mr. Vichai Assarasakorn, Honorary Secretary General of the Board of Trade of Thailand, the panel also included:

  • Dr. Sirilaksana Khoman, Senior Advisor, Office of the National Anti-Corruption Commission
  • H.E. Mr. Niwattumrong Boonsongpaisan, Minister Attached to the Prime Minister’s Office
  • Dr. Bandid Nijathaworn, Secretary General, The Collective Action Coalition of the Thai Private Sector Against Corruption

According to The Nation’s coverage of the event, corruption issues were just one of several topics discussed at the seminar. Other distinguished speakers talked about the need to remove non-tariff barriers and other restrictions on trade, and the positive impact that opening up the market will have on Thai businesses.

Jay Cohen, partner and director of Tilleke & Gibbins in Cambodia, is quoted in a recent Cambodia Investment Review article on the country’s amended Law on Investment. As the article explains, this new law, which replaces an earlier investment law passed in 1994, was approved in a recent meeting of the Council of the Ministers and offers a number of promising incentives, and streamlining some current procedures associated with establishing and operating a business in Cambodia. In the article, Jay notes that the new Law on Investment expands the number of industries eligible to seek investment incentives. He also discusses the law’s tax incentives, explaining that the key to understanding their effect is knowing how they function with other tax regulations in the country. For instance, the profit tax exemption could be largely negated by existing regulations if that profit is paid out in dividends, so this means that the full benefit of the exemption can only be received if the profits are kept in the business itself. Cambodia Investment Review is a local English-language news outlet reporting on issues related to investment in Cambodia, with articles intended for both local and international readers. In response to a question on the outlook for ease of doing business in Thailand, Eric sounded a hopeful note, explaining that the country’s strides in the areas of streamlining and digitizing various aspects of doing business should be able to continue after COVID-19, which has actually hastened digitization in several legal areas that had previously been slower to adapt to recent technological advances.
