David Lyman Discusses Anti-Corruption with Nikkei Asian Review

David Lyman, Tilleke & Gibbins’ Chairman and Chief Values Officer, was quoted in an article by Nikkei Asian Review, titled “Thailand faces uphill battle on anti-corruption campaign.”

Referencing two recent corruption scandals involving British engine manufacturer, Rolls Royce, and U.S. wire and cable manufacturer, General Cable, the article points out that—contrary to their global reputation for commitment to anti-bribery measures—some Anglo-American multinationals have actually been contributing to the recent surge in corruption in Thailand. The article goes on to highlight the importance of the anti-corruption campaign launched by Thailand’s government in 2014.

David was interviewed on the current state of corruption in Thailand. “Under the Yingluck government, I hear corruption had reached 40 to 45 per cent of the project value at one point,” he said. David continued to speak on Prime Minister Prayuth Chan-ocha’s efforts to reduce corruption in the country. “I think they were trying to clean up the mess, because it went too far under the Yingluck government. One of the first things this government did was to double the budget of the National Anti-Corruption Commission virtually on day one.”

The latest “Women in Law” report from Asia Business Law Journal (ABLJ) includes a profile of Tiziana Sucharitkul, co-managing partner and director of the Tilleke & Gibbins’ dispute resolution group. Tiziana also sits on the International Bar Association’s Law Firm Management Committee, which functions as a global forum for leadership and management in the legal practice. Tiziana also spoke with ABLJ about the increasing profile of women lawyers that she has witnessed during her career, noting that she observed the concern about female representation in law firms grow throughout the 1980s and 1990s all the way until the present day, when more women can be seen in management positions, but are still somewhat underrepresented at the managing partner level overall. Dr. Ross Taylor, head of Tilleke & Gibbins’ regional financial services industry group and counsel in the firm’s corporate and commercial team in Laos, Myanmar, and Thailand, provided the basis for a recent article by OneTrust DataGuidance on certain legislative changes in Myanmar since the military’s seizure of power in the country on February 1, 2021. Specifically, Ross described changes to the country’s laws governing privacy and security, as well as legislation on electronic transactions. The Supreme Administrative Council, the highest executive authority in Myanmar’s military government, made amendments that allow the government to conduct surveillance and investigations in a range of situations, while also eliminating certain safeguards of individual privacy and widening the state’s ability to obtain personal data from private operators. Tiziana Sucharitkul, co-managing partner and director of the Tilleke & Gibbins’ dispute resolution group, has been invited to speak at a webinar on May 7, 2021, on diversity and inclusion (D&I) policies and practices at law firms. The webinar is organized by the International Bar Association (IBA) Law Firm Management Committee and will feature insights from several members of IBA leadership as well as other senior professionals from leading law firms and companies around the world. Tiziana, who sits on the committee’s advisory board, will focus especially on how Tilleke & Gibbins develops and implements D&I policies. Her presentation will also be informed by her extensive experience fostering cooperation among law firms and legal practitioners at the international level through her work with IBA, her leadership of the Lex Mundi network, and her firm-to-firm relations as a co-managing partner of Tilleke & Gibbins. The growing push for effective law firm D&I practices not only comes from internal developments but also is driven by investors who demand that companies have sound D&I policies. Law firms have been responding to these various pressures by setting D&I strategies for their own operations as well as by incorporating a D&I perspective into their client advice. On March 29–31, Tilleke & Gibbins’ dispute resolution experts offered a three-episode Thai-language webinar series covering key legal information related to white-collar crime. In the first episode, titled “White-Collar Crime: Theft and Forgery,” Kasamesunt Teerasitsathaporn, a partner in Tilleke & Gibbins’ dispute resolution group, focused on tools available in Thailand for fighting the most common types of white-collar crime—theft and forgery—including the penalties that can be imposed. The following day, Chusert Supasitthumrong, partner and specialist in labor and employment law, continued with a presentation entitled “Investigating White Collar Crimes,” in which he addressed a wide range of offenses that can occur in a company. He also provided practical guidelines for companies to identify potential internal criminal breaches, and outlined steps the can take to confirm or dismiss the allegations. In the final episode, titled “Prosecuting White Collar Crime,” Suruswadee Jaimsuwan, a counsel in the firm’s dispute resolution department, provided an overview of what employers can do to bring cases against employees who commit financial and economic crimes, and offered a detailed discussion of criminal court proceedings.
