Class Action Legal Proceedings Now Available in Thailand

The National Legislative Assembly has passed a bill amending the Civil Procedure Code to allow class action legal proceedings in Thailand. Class action lawsuits were not previously available in Thai proceedings, so this marks a notable development in the country’s court system. The Thai class action legislation contains basic similarities to class actions in jurisdictions such as the United States, albeit with significant differences in both substance and procedure.

The bill has received royal endorsement and will become effective in December 2015 (240 days after publication in the Royal Gazette  dated April 8, 2015). The amended provisions provide for the following:

  • Cases involving a group of persons who have the same interests and rights related to tort, breach of contract, and other laws including environment, consumer protection, labor, securities and stock exchange, and trade competition can petition to be filed as class actions by a plaintiff, which is a class member, together with the complaint.
  • The Court has the power to allow, define the scope or characteristics of a class, inquire into, and terminate a class action.
  • Class members may opt-out of the class action and pursue individual claims.
  • A judgment binds all parties and members of the group. A plaintiff (or attorney) has the power to proceed with execution of the judgment on behalf of all members of the group.
  • Defendants may be held liable for plaintiffs’ attorneys fee awards not exceeding 30% of the judgment amount. Historically, the lawyers’ fees assessed by Thai courts have been very low.

The new class action law attempts to increase judicial efficiency by aggregating a large number of individualized claims into one lawsuit where judgments will be binding on all class members. However, it also opens up opportunities to aggregate small claims that would otherwise not be cost effective to litigate.

Tiziana Sucharitkul, managing partner and director of Tilleke & Gibbins’ dispute resolution group, provided in-depth insights on diversity and inclusion and law firms for a recent article in Asia Business Law Journal (ABLJ) on diversity and inclusion in law firms across Asia. In the article, which was published on March 30, 2022, Tiziana offers insights gained in her years in senior leadership at Tilleke & Gibbins and as a longtime advocate for law firm diversity and inclusion initiatives. The article begins by contrasting the demand for greater diversity among Western law firms—especially by corporate counsel—with attitudes in Asia, where questions of expertise and service often take precedence when it comes to legal work. The writer then quickly shifts to investigating the reasons for this, as well as exploring the current state of diversity in the Asian legal industry today. This section of the article leads with Tiziana’s explanation that leadership of Asian law firms are in a very different context than the social tensions that catalyzed many diversity initiatives in the West. However, this does not necessarily mean that diverse representation has lagged in this part of the world. Rather, as Tiziana points out, “Southeast Asian countries have some of the highest proportions of women in senior business leadership in the world.” She also notes that markers such as gender diversity and respect for minority rights can vary widely across Asia. Elsewhere in the article, other senior law firm leaders express similar observations and provide details on the diversity challenges in their countries of focus. At the annual general meeting of the Inter-Pacific Bar Association (IPBA) on March 24, Pimvimol (June) Vipamaneerut, a partner in the firm’s corporate and commercial group in Bangkok, was elected as IPBA’s jurisdictional committee member for Thailand. In the role, Pimvimol will be responsible for membership issues in Thailand, and will be the key point of contact for matters concerning activities in the jurisdiction. She will serve as Thailand’s jurisdictional committee member for three years (2022–2025). The IPBA is a prestigious international association of business and commercial attorneys active or with a strong interest in the Pacific region. Tiziana Sucharitkul, co-managing partner of Tilleke & Gibbins and director of the firm’s dispute resolution department, spoke in two International Bar Association (IBA) webinars on law firm management and strategic direction. Tiziana appeared in her capacity as a member of the IBA Law Firm Management Committee, first in an IBA Global Showcase session on October 28, 2021, and then again at an IBA Officers’ Briefing on November 9. The first event brought together two panels of law firm managing partners from around the world to discuss the matters of greatest concern to the legal industry in a session titled “What is the Future of our Law Firms?” Together, the panelists discussed issued such as the return to physical offices, how best to serve clients, how to encourage and support collaboration among lawyers, and what pricing strategies will look like in the future. This session formed part of the week-long IBA Global Showcase—a global conference sharing knowledge and celebrating successes in law firm policy and practice. In the second session, open only to officers of the IBA, Tiziana was one of three guests interviewed about law firm transitions and strategy. Alongside managing partners from leading firms in India and the USA, Tiziana discussed how established family-run firms can evolve into regional powerhouses, taking examples from her own experience with Tilleke & Gibbins’ regionalization and growth over the past two decades.
