Class Action Legal Proceedings Now Available in Thailand

The National Legislative Assembly has passed a bill amending the Civil Procedure Code to allow class action legal proceedings in Thailand. Class action lawsuits were not previously available in Thai proceedings, so this marks a notable development in the country’s court system. The Thai class action legislation contains basic similarities to class actions in jurisdictions such as the United States, albeit with significant differences in both substance and procedure.

The bill has received royal endorsement and will become effective in December 2015 (240 days after publication in the Royal Gazette  dated April 8, 2015). The amended provisions provide for the following:

  • Cases involving a group of persons who have the same interests and rights related to tort, breach of contract, and other laws including environment, consumer protection, labor, securities and stock exchange, and trade competition can petition to be filed as class actions by a plaintiff, which is a class member, together with the complaint.
  • The Court has the power to allow, define the scope or characteristics of a class, inquire into, and terminate a class action.
  • Class members may opt-out of the class action and pursue individual claims.
  • A judgment binds all parties and members of the group. A plaintiff (or attorney) has the power to proceed with execution of the judgment on behalf of all members of the group.
  • Defendants may be held liable for plaintiffs’ attorneys fee awards not exceeding 30% of the judgment amount. Historically, the lawyers’ fees assessed by Thai courts have been very low.

The new class action law attempts to increase judicial efficiency by aggregating a large number of individualized claims into one lawsuit where judgments will be binding on all class members. However, it also opens up opportunities to aggregate small claims that would otherwise not be cost effective to litigate.

Andrew Stoutley, chief operating officer of Tilleke & Gibbins, provided a lengthy quote to Asian Legal Business (ALB) for a recent feature on how law firms in Southeast Asia are increasingly using data analytics and information to drive their business strategy. The article featured contributions from a number of partners and executives from firms across Southeast Asia on the different ways that their firms are applying data to their operations and incorporating information and analytics into their strategic decision-making processes. In his contribution, Andrew explained that as technology has become central to virtually all operations at Tilleke & Gibbins, metrics and data have been harnessed to inform decisions at all levels. To illustrate this, he gave the example of a broad strategic planning process that the firm has undertaken to lay out strategy for the coming years. Identifying and gathering key quantitative and qualitative data points was crucial to the process, which considers every element of the firm’s planned operations for the next several years. Andrew went on to discuss the importance of determining how best to share the data with the relevant stakeholders, such as through visualizations or dashboards that allow staff to monitor the progress of operations. The other informants for the article reported a similar uptick in reliance on data—such as in competitive intelligence, billing, and matter management—and emphasized the necessity for firms to recognize the value of data as a resource that must be protected and used wisely. Eric Meyer, a foreign consultant in Tilleke & Gibbins’ dispute resolution department, was profiled in the latest issue of Thai-American Business (T-AB), the quarterly magazine of the American Chamber of Commerce in Thailand (AMCHAM). As co-chair of the AMCHAM Legal Committee, Eric is extremely active in the American business community in Thailand. He applies his unique combination of legal expertise and practical awareness of business concerns in Thailand to identify topics and organize events that are interesting and relevant to a broad range of people. In the T-AB profile, Eric recounts how he came to be involved in AMCHAM after joining Tilleke & Gibbins four years ago, and notes that participation in the group has been an excellent way to stay current with the business community and build connections with professionals across various industries. In response to a question on the outlook for ease of doing business in Thailand, Eric sounded a hopeful note, explaining that the country’s strides in the areas of streamlining and digitizing various aspects of doing business should be able to continue after COVID-19, which has actually hastened digitization in several legal areas that had previously been slower to adapt to recent technological advances. Eric now looks forward to continuing to provide important leadership to the AMCHAM Legal Committee as the country and its business community seek to overcome the persistent challenges of the COVID-19 pandemic and move toward a sustainable economic recovery.

The latest “Women in Law” report from Asia Business Law Journal (ABLJ) includes a profile of Tiziana Sucharitkul, co-managing partner and director of the Tilleke & Gibbins’ dispute resolution group. The special report includes profiles of 20 highly accomplished female legal professionals from the Asia-Pacific region. Tiziana is the only person from Thailand to be included in the feature. Titled “View from the Top,” the profile of Tiziana focuses on her many leadership roles—not only at the helm of Tilleke & Gibbins but also in executive and advisory positions for various global legal associations. For instance, in 2018–2019 Tiziana served as chair of the board of Lex Mundi, the world’s leading global network of independent law firms, and she currently sits on the board of the Lex Mundi Pro Bono Foundation and is an active participant in the organization’s Women’s Initiative Network to Success. Tiziana also sits on the International Bar Association’s Law Firm Management Committee, which functions as a global forum for leadership and management in the legal practice. Tiziana also spoke with ABLJ about the increasing profile of women lawyers that she has witnessed during her career, noting that she observed the concern about female representation in law firms grow throughout the 1980s and 1990s all the way until the present day, when more women can be seen in management positions, but are still somewhat underrepresented at the managing partner level overall. Tiziana Sucharitkul, co-managing partner and director of the Tilleke & Gibbins’ dispute resolution group, has been invited to speak at a webinar on May 7, 2021, on diversity and inclusion (D&I) policies and practices at law firms. The webinar is organized by the International Bar Association (IBA) Law Firm Management Committee and will feature insights from several members of IBA leadership as well as other senior professionals from leading law firms and companies around the world. Tiziana, who sits on the committee’s advisory board, will focus especially on how Tilleke & Gibbins develops and implements D&I policies. Her presentation will also be informed by her extensive experience fostering cooperation among law firms and legal practitioners at the international level through her work with IBA, her leadership of the Lex Mundi network, and her firm-to-firm relations as a co-managing partner of Tilleke & Gibbins. The growing push for effective law firm D&I practices not only comes from internal developments but also is driven by investors who demand that companies have sound D&I policies. Law firms have been responding to these various pressures by setting D&I strategies for their own operations as well as by incorporating a D&I perspective into their client advice.
