Asia IP: Thailand Paves Way to Madrid

An article published by Asia IP, “Thailand Paves Way to Madrid,” describes the amendments to Thai laws that are being made to meet international standards. The article takes a detailed look at the proposed changes and any subsequent challenges that the Thai legal system might face. The article features analysis from several prominent practitioners, including members of the Tilleke & Gibbins team.

According the Darani Vachanavuttivong, co-managing partner and managing director of IP at Tilleke & Gibbins, “it is important for Thailand … to show that it is a nation that is capable of fitting in with international conventions and in line with the spirit of market access under the ASEAN Economic Community (AEC).” The article also quotes Alan Adcock, partner and deputy director of the firm’s IP group, on how the new multiple-class trademark that has been proposed is more advantageous and efficient for applicants, while also stating that the Madrid system will make the trademark application process easier, but that the centralized nature of the process means that specifications can be complex and problematic, and therefore local advice is vital to filing under the Madrid system.  In regard to other changes, James Evans, a Tilleke & Gibbins consultant, is skeptical about the benefits that the ASPEC program has bought to Thailand, and thinks it would be better suited to the “lesser developed countries.”

The article also profiles law firms in Thailand and makes reference to previously determined rankings, in which Tilleke & Gibbins has received a Tier 1 ranking in all fields of intellectual property; trademark prosecution, trademark contentious, patent prosecution, and patent contentious.
