ALB Vietnam In-House Legal Summit 2018: Tilleke & Gibbins to Speak on Labor and Compliance

On Thursday, June 7, Asian Legal Business will hold its second annual Vietnam In-House Legal Summit, a conference targeting in-house counsel, chief compliance officers, and other business leaders in Vietnam to offer insight on important legal issues such as corporate liability, business challenges from new legislation, and compliance.

Tilleke & Gibbins is a co-sponsor of the conference, and will wrap up the half-day event with a presentation on “Avoiding Employment Law Pitfalls, Ensuring Good Compliance, and Protecting Company Trade Secrets.” Thomas J. Treutler, managing director of the firm’s Vietnam offices, partners Dr. Vinh Quoc Nguyen and Kien Trung Trinh, and attorney Chuyen Hong Huu Le will share tips and practical advice on hiring and firing in Vietnam, effective compliance training for employees, and protecting IP and trade secrets in the workplace and with mobile employees.

The Vietnam In-House Summit will be held at the Sofitel Saigon Plaza in Ho Chi Minh City and is free to attend for in-house counsel. On August 19, Sher Hann Chua, a consultant in Tilleke & Gibbins’ Bangkok and Yangon offices, presented a session to the Thailand chapter of the Society of Petroleum Engineers (SPE) titled “An Overview of Intellectual Property: What to Focus on in the Contract and the Field.” Moderated by Joseph Tomkiewicz, partner and co-chair of Tilleke & Gibbins’ regional energy practice, the session focused on the intellectual property (IP) rights and issues that are most relevant to the oil and gas industry. In discussing IP rights and how they function in the energy sector, Sher Hann presented an overview of trademarks, patents, industrial designs, and copyright, before emphasizing the crucial role that IP plays in major commercial transactions such as mergers and acquisitions. She also analyzed classic IP pitfalls that parties makes when working with others under a contractual arrangement, and providing practical tips on how to avoid these missteps.

On August 16, Tilleke & Gibbins collaborated with the Thai Listed Companies Association (TLCA) to organize a Thai-language webinar titled, “Temporary Business Shutdown during the COVID-19 Outbreak” to assist business that have opted to temporarily shut down in order to alleviate financial difficulties due to the ongoing COVID-19 outbreak in Thailand In this webinar, Chusert Supasitthumrong, partner, and Piyawat Vitooraporn, associate, both in Tilleke & Gibbins’ dispute resolution group, discussed the criteria for temporary business shutdown under section 75 of the Labor Protection Act B.E. 2541 (1998), addressed employers’ right to government subsidies, and offered suggestions to business owners about how they can benefit from various relief measures. On August 5, Athistha (Nop) Chitranukroh and Peerapong Pornpipatkul of Tilleke & Gibbins’ corporate and commercial group in Bangkok were welcomed as keynote speakers for a session entitled “Legal Unfolded” under the Startup Starter Kit series. Hosted by Global Startup Thailand—an initiative cofounded by Startup Thailand and the National Innovation Agency (NIA)—the Startup Starter Kit series is designed to provide practical business advice to local and international entrepreneurs looking to capitalize on new opportunities in Thailand. During the session, Athistha and Peerapong led attendees through an in-depth look at common legal concerns for startups in Thailand, including extensive discussions on: local laws and legal issues to consider before fundraising; negotiating term sheets, share subscription agreements, and shareholders’ agreements; Thai cybersecurity and data protection laws; and potential exit strategies for entrepreneurs. On July 20, Chusert Supasitthumrong, partner and head of Tilleke & Gibbins contentious employment practice, and Jamorn Pornponwat, an associate in the firm’s dispute resolution group, teamed up to present a practical online session entitled “Employment Contract Basics – Key Considerations for Thai Employers.” Hosted jointly by Tilleke & Gibbins and True Digital Park, one of Southeast Asia’s largest tech and startup hubs, the webinar provided an overview of the core elements found in employment contracts in Thailand, including in-depth discussions on: the importance of non-competition clauses for innovative companies and other standard employment contract clauses; the distinction between employees and freelancers and how Thai companies can prepare contracts for freelancers; and, the legal process for terminating employees in Thailand.
