Biography

Wong Vorravitwattana is a senior associate in Tilleke & Gibbins’ intellectual property group in Bangkok, where he advises and represents numerous international and domestic clients on securing, protecting, and enforcing their intellectual property rights. He has a particular focus on IP litigation and enforcement as well as all other contentious matters, including trademark and trade name infringement, passing off, copyright infringement, patent infringement, and licensing agreements.

Prior to joining Tilleke & Gibbins, Wong worked at other leading law firms in Thailand, handling a number of high-profile IP cases before the Intellectual Property and International Trade Court. In addition to IP disputes, his experience extends to a diverse spectrum of complex litigation and arbitration matters, including employment, international trade, maritime, real estate, construction, business reorganization, bankruptcy, financial transactions, defamation, investigations in connection with Thailand’s Securities and Exchange Act, arbitral award enforcement, directors’ liability, shareholder disputes, and cross-border disputes.

Wong holds an LLM from Durham University and an LLB from Thammasat University. He is a qualified lawyer in Thailand and a member of the Lawyers Council of Thailand and the Thai Bar Association.

  • Represented a leading global American sandwich restaurant franchisor in litigation against a former franchisee operating over 100 outlets in Thailand for unauthorized brand use after franchise termination, securing injunctive relief and pursuing over THB 200 million in damages. The case set a key precedent for injunctive relief in franchise protection.
  • Represented a leading Chinese coffeehouse chain in trademark litigation in Thailand involving cancellation and passing off claims, securing a landmark judgment confirming superior rights, with trademark cancellations, corporate name changes, and over THB 10 million in damages plus THB 100,000 daily penalties, the highest award in a Thai trademark case.
  • Represented a leading global Chinese lifestyle retailer in IP licensing disputes against its former licensee for continued unauthorized use of trademarks and business assets following termination, claiming damages exceeding THB 570 million and seeking enforcement of posttermination noncompetition and debranding obligations.
  • Advised a leading Korean sandwich brand in franchise litigation in Thailand against its former master franchisee for continued unauthorized use of trademarks following termination, and successfully enforced cessation of infringing activities and the rebranding of the outlet.
  • Represented Thailand’s national energy group in high-stakes IP litigation against parties engaged in large-scale trademark registration involving over 50 unauthorized filings and secured trademark cancellations.
  • Represented a large transactional bank in its successful defense against a trade finance software provider in relation to a civil copyright infringement claim of more than THB 200 million in connection with breaches of a software license and a maintenance agreement.
  • Represented a world-leading international digital company in initiating several lawsuits against local companies for trade name and trademark infringement and obtained favorable settlements and court decisions relating to registration of name change, registration of new domain name, cessation of infringement, and monetary damages.
  • Acted for a well-known Thai music star and all members of a reputable band to defend against former band members’ claims in connection with trade name and trademark infringement.
  • Represented a Japan-based company operating franchised restaurant businesses against its local partner, claiming damages of more than THB 150 million with regard to breach of a franchise agreement and joint venture agreement as well as unfair trade practices.
  • Acted for a leading airline operator in its business rehabilitation to secure its business with a total amount of claims involved in the rehabilitation exceeding THB 25 billion.

In March 2025, Thailand’s Central Intellectual Property and International Trade Court (IP&IT Court) issued a landmark judgment in favor of Luckin Coffee, China’s leading retail coffee chain. The judgment marked a significant turnaround following earlier trademark litigation involving Luckin Coffee from 2021 to 2023 that had generated widespread public attention and raised questions about the protection available to legitimate foreign brand owners in Thailand. In a significant subsequent development, Thailand’s Court of Appeal for Specialized Cases has now affirmed the IP&IT Court’s judgment in its entirety. The appellate decision brings clarity to one of Thailand’s most closely watched trademark disputes. Significantly, this is the first case in Thailand to formally recognize the trademark squatting principle. The Court of Appeal confirmed that Luckin Coffee has a better right to the disputed mark and ordered cancellation of the defendants’ trademark registration—a key application of the “better right” doctrine. The court also upheld the substantial damages awarded at first instance, providing important guidance on assessing harm from systematic trademark squatting. Award-Winning Judgment Affirmed in Its Entirety The significance of the first-instance judgment extended beyond the outcome for Luckin Coffee. The IP&IT Court judgment was subsequently recognized in the IP&IT Court’s Distinguished Judgment Awards in 2025, reflecting the complexity, novelty, and legal significance of the issues considered in the case. The defendants nevertheless appealed the judgment, challenging several key aspects of the IP&IT Court’s decision. Luckin Coffee continued to entrust Tilleke & Gibbins as their sole attorney to pursue the case at the appellate level. After considering the defendants’ appeal and Luckin Coffee’s submissions in response, the Court of Appeal affirmed the first-instance judgment in its entirety. For multinational franchisors operating in Thailand, a key risk after franchise termination is that former outlets may continue operating in ways that could easily mislead consumers into believing they remain within the authorized network. To justify such operations, former franchisees often argue that the termination was invalid or ineffective. As a result, these cases are often treated as contractual disputes, making it difficult for franchisors to obtain injunctive relief before a final judgment confirms that the termination was lawful. Franchisors face significant commercial and reputational harm during lengthy proceedings, including consumer confusion, disruption to franchise restructuring, and damage to brand reputation and customer trust. In an encouraging development, the Thai court in a 2025 case responded to the problem of unauthorized post-termination franchise operations by granting interim relief, recognizing broader brand and consumer harm, and awarding substantial damages, highlighting a successful litigation strategy of framing the dispute not merely as a contractual termination issue but as trademark infringement causing ongoing commercial injury. The Subway Case From December 2024 to mid-2025, an unauthorized “Subway®” franchise operation in Thailand attracted substantial public and media attention. Reports and online discussions about unauthorized Subway® stores circulated widely after complaints arose about food quality and customer experience at certain outlets that were allegedly operating after their franchise rights had expired. Because these stores continued to use Subway® trademarks, trade dress, and overall commercial appearance, many consumers were unable to distinguish them from authorized operations, resulting in reputational risks and customer confusion that affected the franchisor’s brand and franchise system in Thailand. Subway treated this matter with the utmost seriousness and moved promptly to protect its brand, franchise system, and customers.
