Biography

Pasin Supawan is an associate in Tilleke & Gibbins’ intellectual property department in Bangkok. Pasin provides global, regional, and domestic companies with actionable legal advice on IP protection and enforcement, as well as litigation in Thailand’s Intellectual Property and International Trade Court (IP&IT Court). He also assists clients with trademark and other intellectual property needs, including the preparation, filing, amendment, disclaimer, and renewal of trademark applications.

Prior to joining Tilleke & Gibbins, Pasin studied for his LLB at Chulalongkorn University, during which he served as president of the International Mooting Association of Chulalongkorn University. Pasin is fluent in Thai and English.

  • Assisted in a THB 1.6 billion IP asset acquisition project for one of the globe’s top three most influential multinational leaders in the music entertainment industry, involving the acquisition of over 10,000 master recordings and 6,000 copyrights, publishing rights, and licenses spanning from 1981 to 2022, showcasing the artistic endeavors of over 960 creators, from Thailand’s second-largest music record label.
  • Assisted teams in researching and analyzing decisions and case law related to passing off and unfair competition.
  • Conducted trademark searches to assess the uniqueness of clients’ marks and determine the probability of successful registration.
  • Drafted a counterappeal to successfully prosecute trademark registration for a client.

Tilleke & Gibbins is proud to announce that four litigation cases handled by the firm have been selected among the nine Distinguished Judgment Awards granted by Thailand’s Central Intellectual Property and International Trade Court (IP&IT Court) for the period from October 1, 2024, to August 31, 2025. This recognition highlights the complexity, novelty, and legal significance of these cases, which were chosen based on stringent criteria including new legal issues, high evidentiary volume, and intricate legal arguments. Among these four cases, one was singled out as the “Most Distinguished Judgment” – the landmark trademark squatting case involving the trademark rights of our client, Thailand’s largest state-owned energy conglomerate, and its subsidiary. In this case, the defendants had filed 52 trademark applications mimicking our client’s marks, making it the largest trademark squatting dispute in Thai history. On April 30, 2025, the IP&IT Court ordered the cancellation of multiple infringing trademarks, setting a benchmark for IP enforcement against trademark squatters in Thailand. The other three recognized cases demonstrate Tilleke & Gibbins’ breadth of expertise in IP litigation: Patent infringement and invalidation involving trade secrets misappropriation. Trade dress infringement of a unique packaging. Landmark Luckin Coffee case involving trademark infringement and invalidation. The IP&IT Court handles approximately 200 IP civil litigation cases each year, and our IP litigation team has typically been involved in 25–30% of them, reflecting our dominant role in shaping IP jurisprudence in Thailand.

Life sciences specialists from Tilleke & Gibbins have updated the firm’s guide to pharmaceutical data exclusivity regulations and practices in Southeast Asia. This guide contains quick-reference information on the availability of data exclusivity protections and limitations in Cambodia, Indonesia, Laos, Malaysia, Myanmar, Thailand, and Vietnam. Developing and launching a new drug on a commercial scale requires an enormous amount of time and investment in research and development (R&D), including pre-clinical testing and clinical trials. When considering the aggregate amount of drug development costs, it is important to recognize that this includes not only the investment in developing new drugs that get approved by a government food and drug regulator and are successfully brought to market, but also the R&D expenditures on a large number of potential pharmaceutical compounds and products that never actually make it to market. In particular, considerable investment is required in order to conduct and produce clinical trial data—to prove safety, efficacy and effectiveness of a new drug—that would warrant marketing approval by the regulatory authority. Such data is proprietary in nature and highly valuable for a research-based pharmaceutical company that develops an original drug. On the other hand, patent law typically confers generic drug manufacturers with the ability to engage in various preparatory activities with a view to obtaining marketing approval for a generic product before the patent for the original drug expires (commonly known as a “Bolar provision”). Continuing the approach introduced last year, the rankings present a unified table in each jurisdiction, combining patent and trademark/copyright work to provide a more holistic view of the IP market.
