  • Data Privacy and Cyber Security. As governments across the region introduce new laws and regulations around data protection, data privacy, and cyber security, we assist clients with assessing this critical area of business risk; complying with the range of regulatory requirements within each Southeast Asian jurisdiction; managing compliance policies and programs, including Thailand's PDPA and extraterritorial GDPR compliance; advising on cross-border data transmission; investigating suspected and confirmed data breaches; and responding to incidents or regulatory scrutiny.
  • Broadcast Media and Film. Our intellectual property, corporate and commercial, and labor lawyers have extensive experience in the media and entertainment industries, and are particularly adept at matters relating to filming in Thailand. We regularly advise on pre-production and production contracts and regulatory issues, including copyright and life rights, employment matters related to local and international cast and crew (in collaboration with our industry-leading employment law practice), environmental clearance, equipment import and rental agreements, filming permits, government permits and approval, and location agreements. 
  • Digital Media. Tilleke & Gibbins assists major players in the social media and entertainment industries as they navigate the complex and often nascent regulatory landscapes of Southeast Asia, and have worked with many of the world's largest social media and OTT video broadcasting companies to ensure that Southeast Asia remains one of their largest and most engage user bases.
  • FinTech. We advise the world’s foremost financial institutions FinTech regulation and commercial transactions, including e-payments and international online financial product offerings. We are also at the cutting edge of blockchain utilization and digital currency, advising clients on regulatory and taxation issues, initial coin offerings (ICOs), and other key legal issues affecting this dynamic area of business. 
  • Protecting Innovation. Tilleke & Gibbins' intellectual property team play a key role in the Technology industry group, helping to protect innovation and ensure the clearance and licensing of intellectual property as it relates to film, television, radio, and Internet content. On the hardware side, our patent team includes multiple electronic engineers and other technical specialists to make sure that we speak the same language in every matter in which we are engaged. 
  • Telecommunications Infrastructure. Tilleke & Gibbins has been at the legal advisor of choice for companies seeking to build, develop, and operate network infrastructure in Southeast Asia for decades. Whether it's undersea cable construction; IXP and receiving terminal operation; datacenter construction and maintenance; acquisition or construction of telecommunications masts; or orbital slot allocation for satellites, Tilleke & Gibbins partners closely with the government's that regulate the industry and the companies that keep the world's data flowing. 

A small sample of recent matters that we have handled in the technology sector are provided below:

  • Advised one of the largest telecommunications firms in Japan on offering mobile and cloud-based services in Southeast Asia. We advised on company establishment, licensure, and regulations pertaining to various services and business models.

  • Represented a major U.S. telecommunications and software vendor in negotiations with five Thai mobile telecom operators to deploy mobile number portability (MNP) in Thailand. We successfully negotiated the deal to full deployment, which included a build operate and agreed optional transfer build out. We also handled the formation of the client’s Thai subsidiary and associated visa/work permits and required Thai bank guarantees. MNP is now up and available in Thailand, and we continue to advise the client on mobile virtual network operator regulations and the offering of SMS services.

  • Advised Voice over IP (VoIP) operators on numbering regulations and related business issues.

  • Represented credit card network operators and electronic payment companies on licensing and regulatory requirements.

  • Advised multinational telecommunications operators on data privacy, data retention, and lawful interception. 

  • Advised a consortium of financial institutions on telecommunications laws in connection with their bids to provide credit facilities (totaling THB 15.85 billion) to a major telecommunications operator for the expansion of a 3G mobile network and infrastructure.

  • Advised a global technology company on the launch of a network game platform in Thailand; including counseling on censorship and obscenity laws.

  • Advised a leading global Internet brand and an international video game company on website development, Internet services, and the legal implications of same.

  • Advised a Japanese-Chinese joint venture on the regional broadcast distribution of an animated television series, including advising on intellectual property assignment and registration in preparation for licensing and merchandising opportunities.

  • Assisted a producer of real-time strategy games with the launch of their latest offering in Thailand. Much of our work focused on localizing business approaches and terms of use. The game went on to meet with considerable success, both in Thailand and overseas.

  • Advised a multinational media company on a regional copyright dispute in the broadcasting field.

  • Advised a leader in wireless technology on government authorities related to the telecommunications industry.

  • Liaised with the Ministry of Information and Communication Technology (MICT) on behalf of our client, an operator of a social-media website, to ensure compliance with the Computer Crime Act and, as a result, successfully prevented the website from being banned by the MICT.

  • Helped a multinational company establish a foreign direct investment company engaged in the import/export and distribution of mobile phones and computers.  The established company is one of the few foreign-owned companies permitted to do business in this sector in Vietnam.

  • Provided in-depth advice to a global software solutions provider on doing business in Vietnam.
