Tips on Buying IP in Asia

Managing Intellectual Property

Alan Adcock, Partner and Deputy Director of the IP group at Tilleke & Gibbins, was a panelist this week at Managing Intellectual Property’s second annual China-International IP Forum in Beijing. Following the successful event, Managing IP published an article highlighting Alan’s advice for companies acquiring intellectual assets in Asia.

Focusing on the differences between acquisitions in Asia and those in Western countries, Alan emphasized the importance of entering the process with well-defined objectives and conducting thorough due diligence. “Asian clients a lot of times don’t understand the non-disclosure agreement. Due diligence is a strategic part of the transaction where you can tell the seller to clean up the IP portfolio,” Alan told the audience. He also talked about clearly identifying the IP that the buyer would like to purchase, as well as transitional arrangements to facilitate the acquisition.
