Tilleke & Gibbins Lawyers Interviewed on Blockchain Technology

Two associates from Tilleke & Gibbins’ Hanoi office shared their thoughts on the impact of blockchain technology on intellectual property in an in-depth article published by Asia IP magazine.

Attorney Anh Hoai Nguyen explained that blockchain opened up new opportunities for individuals and SMES, encouraging them to “participate in the niche of IP rights protection, which has so far been dominated mostly by industrial giants with sufficient resources to follow the complicated and lengthy procedures of IP registration, management and enforcement. Blockchain technology could greatly simplify such procedures and make them more straightforward, allowing almost anyone on the Internet to claim ownership of their IP rights.”

Consultant Duc Anh Tran added that despite its promise, blockchain also introduces some challenges. “For example, blockchain can only provide proof of existence/creation or first use of a work, without being able to guarantee the trustworthiness of it. The only thing it can guarantee is that such work has not been tampered with. Therefore, blockchain cannot give definitive evidence that the person who registers the work on the chain is in fact the original creator of the work. In fact, nothing can prevent a malicious participant from adding a pirated version of the work to the blockchain, as there is no requirement for such participant to attach any kind of evidence of ownership together with the work.”

Concluding the article, Hoai Anh expressed optimism for the future of blockchain in IP: “Especially in this new normal of the COVID-19 pandemic, there are many cases where blockchain could help provide solutions to urgent global needs. For example, in the healthcare sector, blockchain could aid in the improvement of supply chain management, the collection, aggregation and access to research data, or clinical credentialing management. There is no doubt that the practical application and legal implications of blockchain still have to be thoroughly assessed, given the many challenges. However, if states, and especially regulators and legislators, are determined to create an ecosystem conducive to the widespread adoption and development of blockchain, the above-mentioned issues have many chances to be addressed.”

On May 24, 2022, Tilleke & Gibbins was joined by the British Chamber of Commerce Thailand (BCCT) in holding an event entitled “7-Day Countdown: What to Know about Personal Data Protection Act Enforcement” at the Conrad Bangkok hotel. The event aimed to equip the British business community in Thailand with essential knowledge to be fully compliant with the law. During the event,  Nopparat Lalitkomon, senior associate, and Gvavalin Mahakunkitchareon, associate, walked attendees through the following key considerations: Roles and responsibilities of data controllers and data processors; Management of personal data collected prior to the effective date of the PDPA; and Practical advice to avoid potential pitfalls. On April 20, three attorneys from Tilleke & Gibbins’ corporate and commercial group—Gvavalin Mahakunkitchareon, associate; Nopparat Lalitkomon, senior associate; and Pongpalin Chantrapirom, associate—offered a Thai-language webinar entitled “Personal Data Protection Compliance Preparation.” During the session, the three speakers gave a comprehensive overview of Thailand’s data protection regulatory regime to assist attendees in complying with the Personal Data Protection Act BE 2562 (PDPA), which will come into full effect on June 1, 2022. In particular, the speakers covered the following topics: Key principles of personal data collection; PDPA compliance considerations for insurance companies; Notification of data collection and data processing in accordance with the law; Managing personal data collected prior to the effective date of the PDPA; Penalties for noncompliance with the PDPA; and Comparative case studies involving the EU’s GDPR (General Data Protection Regulation). On April 8, Nopparat Lalitkomon, senior associate in the firm’s corporate and commercial group in Bangkok, took part in a webinar titled “Be Ready for Thai PDPA,” cohosted by Cisco Systems. The virtual event aimed to assist businesses in preparing for enforcement of Thailand’s Personal Data Protection Act (PDPA), which takes full effect on June 1, 2022. In his presentation, which was titled, “Get Ready for PDPA: Timeline, Regulations and What’s to Come,” Nopparat outlined the key principles of the PDPA and its related regulations, and highlighted necessary steps that Thai companies need to take as the deadline draws closer. At the conclusion of the session, He provided attendees with practical advice they can use to help their companies effectively manage their internal system to comply with the PDPA in June.
