Ross Taylor Quoted by Myanmar Times on Trade Bill

Ross Taylor, counsel in Tilleke & Gibbins’ corporate and commercial practice, was recently quoted by the Myanmar Times  in an article on draft trade legislation currently under consideration. With insights gleaned from extensive experience facilitating trading businesses in Myanmar—as well as his current position on the board of the British Chamber of Commerce—Ross is well positioned to comment on the bill and what practical effects it would have.

In keeping with his comments, the article takes a largely cautionary tone on the proposed legislation. Essentially, if the draft law were to be enacted, it would introduce a new layer of bureaucratic regulation across a wide swath of industries and business sectors. Under the proposed regime, the government would be able to set price controls based on loosely defined criteria; the law would also establish a development-focused body to determine restrictions on certain items, issue other regulations, and form new committees and subcommittees on related issues. Another major element of the bill is a requirement that trading businesses in Myanmar obtain a trade registration certificate to operate in the country.

Ross, who has commented elsewhere in support of Myanmar’s substantial and relatively fast-paced legislative reforms and their positive effects on doing business in the country, noted that this particular draft law is “opposed to the direction of recent government thinking and all recent government legislation, which has had the effect of a general and welcome liberalisation in trade and services.” He explained to the newspaper that the permitting requirements are especially concerning, as businesses already have to comply with industry-specific registration requirements.

Dr. Vinh Quoc Nguyen, a partner with the corporate and commercial team in Tilleke & Gibbins’ Ho Chi Minh City office, has been elected to serve a one-year term as chair of the Vietnam Business Lawyers Club (VBLC), a leading professional organization affiliated with the Vietnam Bar Federation. VBLC was established in 2015 with the mission of developing a collaborative group of Vietnamese lawyers engaged in cross-border commercial practice. In addition to providing a forum for practitioners to share experience and offer mutual support, VBLC regularly conducts classes and seminars, and advises lawmakers on policy issues. A well-known figure in Vietnam legal circles, Dr. Vinh is also a lecturer at the Judicial Academy and an arbitrator with the Vietnam International Arbitration Centre (VIAC). In November 2021, he was honored by Vietnam’s Ministry of Justice for his contributions to the development of the country’s legal practice.

Asia Business Law Journal (ABLJ) has published a story on Tilleke & Gibbins’ recent addition of Derrick Khoo to the Tilleke & Gibbins regional corporate and M&A team. As the article notes, Derrick came to Tilleke & Gibbins after several years as a general counsel handling a wide variety of international corporate legal matters. Dr. Vinh Quoc Nguyen, a partner in the firm’s Ho Chi Minh City office,  has been formally recognized by Vietnam’s Ministry of Justice as a key contributor to the development of the country’s legal profession. In Decision No. 1709/QD/BTP dated November 12, 2021, the Minister of Justice issued commendations to 13 groups and 40 individuals for their “exceptional achievements in the process of implementing and summarizing 10 years of the strategy for developing the lawyer profession and the scheme for developing a team of lawyers to serve international economic integration through the year 2020.” Dr. Vinh, who in addition to his work for Tilleke & Gibbins has served as a lecturer at the Judicial Academy for many years , was one of only 14 private-practice lawyers among the 40 individuals highlighted, the majority of whom are employed by the Ministry of Justice or other government agencies.
