Penrurk Phetmani to Speak at AMCHAM Event on Immigration Law

On September 4, 2019, Penrurk Phetmani, an attorney-at-law in Tilleke & Gibbins’ corporate and commercial group, will speak at an event on the Immigration Bureau’s enforcement of the TM30 regulation—requiring the prompt reporting of foreigners’ movements in the country—and other visa and work permit updates. The Immigration Bureau’s recent renewed strict application of the long-overlooked TM30 regulation has been a hot topic that has stirred much discussion among foreign residents, travelers, and Thai landlords. While the officials contend that the enforcement is an essential tool for thwarting national security risks to Thailand, many foreigners and property owners have argued that the reporting requirement is disproportionate and ineffective at mitigating security risks.

Penrurk will discuss this and other issues as one of two invited speakers at the event, hosted by the legal committee of the American Chamber of Commerce in Thailand (AMCHAM). Penrurk, who specializes in immigration matters such as work permits, visas, permanent residence issues, and foreign business licensing, will share her analysis of the TM30 law, its current application, and other pertinent immigration issues. This will be followed by an open Q&A session.

The event will be held at the Bourbon Street Bangkok restaurant at 5:30 p.m. and includes a three-course dinner. The cost is 400 baht for AMCHAM members and 600 baht for non-members (registration required). For more information or to register, please see the event page.

The 2022 forum offered 7 sessions, covering a range of labor law applicable to Cambodia, Laos, Myanmar, Thailand, and Vietnam. On November 23, Chitchai Punsan highlighted criminal proceedings relating to Thailand’s Labor Protection Act B.E. 2541 (1998). On November 24, Suruswadee Jaimsuwan and Pathanin Sornchangwat discussed complex procedural laws in labor disputes (video recording available here) with a focus on class actions and arbitration. On November 17, Tilleke & Gibbins’ employment team in Bangkok continued its outreach to companies at Thai industrial estates by leading an employment law seminar at Hitech Ayutthaya industrial estate. Chusert Supasitthumrong, partner and director of Tilleke and Gibbins’ dispute resolution department in Bangkok commenced the first session by going over the basis of changing employment conditions and agreements according to the Labour Protection Act, conditions and requirements for strikes and lockouts, and illustrating the issues with case studies from his experience. The second presentation was delivered by Piyawat Vitooraporn, an associate from the same department. Piyawat covered termination of employment in Thailand, detailing potential legal consequences of terminating employees, statutory termination payments, and unfair termination. This session at Hitech Ayutthaya industrial estate is part of a series of trainings and seminars that Tilleke & Gibbins’ employment specialists are organizing at industrial estates in Thailand to increase companies’ understanding of Thailand’s employment laws and the benefits of complying with these regulations.

On October 19, Chusert Supasitthumrong, partner and director of the firm’s dispute resolution department, and Suruswadee Jaimsuwan, counsel from the same department, offered an in-person seminar on labor law to assist companies in coping with ongoing issues and consequences of the COVID-19 pandemic and the current economic climate. After being welcomed by AMATA Corporation’s corporate communications senior section manager, Chusert began by giving attendees an overview of employment legal issues and concepts, such as employer-employee agreements, principles of labor demands, and strikes and lockouts. In the second part of the session, Suruswadee focused on termination of employment, highlighting notable consequences employers may face when terminating employees, rules for statutory termination payments, and unfair termination. This session at the AMATA City Chonburi Industrial Estate is part of a series of trainings and seminars that Tilleke & Gibbins’ employment specialists are organizing at industrial estates in Thailand to increase companies’ understanding of Thailand’s employment laws and the benefits of complying with these regulations.

On September 22, employment law specialists from Tilleke & Gibbins in Bangkok held a seminar to address current issues relating to employment regulations in Thailand for companies at Gemopolis Industrial Estate in eastern Bangkok. The presentations were on two main topics—employment conditions and termination of employment. Chusert Supasitthumrong, partner and director of the firm’s dispute resolution department, led the first presentation. In the session, Chusert gave an overview of employment conditions and agreements, discussed strikes and lockouts, noted some illustrative case studies, and provided practical advice on how companies can alter their employees’ contracts in compliance with Thai law. The second installment of the seminar was delivered by Piyawat Vitooraporn, an associate from the dispute resolution department. He explained for attendees the key considerations in termination of employment, including procedures, consequences, and causes of unfair termination.
