Luxsiri Supakijjanusorn, an attorney-at-law in Tilleke & Gibbins’ corporate and commercial group, has been quoted in an article by PaRR, an online resource that provides information on competition law and related fields. Global mergers have the potential to constrain competition in the Thai market, and under proposed amendments to Thailand’s Trade Competition Act, the country’s competition authority will need to be notified if this is the case.

Commenting on this issue, Luxsiri said that, in practice, the way private companies operate is unlikely to be impacted—many large U.S.-based or U.K.-based multinational companies have in place strict antirust compliance policies, which they promulgate globally across their subsidiaries. Although the amendments provide for the possibility of greater penalties, “whether or not this will have any deterrent effect would ultimately depend on enforcement,” Luxsiri said.
