Nandana Indananda Featured in Article on ASEAN Law Association Meeting

Nandana Indananda, a partner in Tilleke & Gibbins’ intellectual property practice, was interviewed by the Thai Post for their recent article about the ASEAN Law Association (ALA) Governing Council Meeting, which took place on November 21–22 in Phuket. Nandana, who is also vice president of the Lawyer’s Council of Thailand’s (LCT) subcommittee on foreign affairs, was joined at the event by Waralee Sripawadkul, attorney-at-law in the firm’s intellectual property group. Together they represented Tilleke & Gibbins at the two-day meeting.

The Thai Post article summarized the meeting, which was organized to promote collaboration between lawyers in ASEAN countries and foster cooperation for arbitration and dispute resolution in the region. Participants included judges (Nandana is himself a former judge of the Intellectual Property and International Trade Court), attorneys, representatives from the Office of the Attorney General, public prosecutors, legal professors, and others.

The newspaper went on to interview Nandana about the LCT and the role of law firms in general in Thai society. Nandana explained that the LCT oversees attorneys and law firms to ensure that they uphold professional standards. He also discussed the activities of law firms in providing legal consultation, particularly for business owners who would like to operate in Thailand and ASEAN countries. He emphasized that being equipped with legal knowledge of each jurisdiction is crucial for investors and entrepreneurs looking to do business in other countries, and he brought up the work Tilleke & Gibbins does advising on trading, investment, intellectual property registration and much more for Thai and foreign business owners who would like to expand their business operations to new locales.

Finally, Nandana noted how the LCT and law firms in Thailand give back to society through pro bono services for Thais and expats in need and by providing legal advice to foundations and NGOs.

Noppramart Thammateeradaycho, a counsel in Tilleke & Gibbins’ dispute resolution practice, has been appointed to the new panel of arbitrators announced recently by the Shanghai Arbitration Commission (SHAC). Noppramart, who was one of two attorneys from Thailand named to the new SHAC arbitration panel, will provide particular support in relation to arbitration of disputes involving the maritime, transportation, insurance, and construction sectors. She is joined on the panel by arbitrators from a wide range of professional backgrounds, with expertise diverse fields including economics, judicial procedure, business, intellectual property, finance, and many more. SHAC, which has grown considerably since its establishment in 1995, is one of the major international arbitration institutions in China. It provides alternative dispute resolution services to companies, organizations, and individuals involved in contentious matters that both parties have agreed to resolve through arbitration rather than litigation.

Partner Loc Xuan Le shared his thoughts on Vietnam’s accession to the WIPO Copyright Treaty (WCT), a special agreement under the Berne Convention, with a reporter from Asia IP magazine in a recent article: “In my opinion, Vietnam’s Law on Intellectual Property has already covered and satisfied WCT’s requirements, so the accession to WCT is just us acting on our commitment when we joined the EU – Vietnam Free Trade Agreement and the Comprehensive and Progressive Agreement and Progressive Agreement for Trans-Pacific Partnership. On December 15–16, Kasamesunt Teerasitsathaporn and Pongpalin Chantrapirom of the firm’s dispute resolution group in Bangkok offered a two-part Thai-language webinar series titled “Violations of the Personal Data Protection Act and Case Studies in Europe” to equip Thai businesses with proper knowledge and understanding before Thailand’s Personal Data Protection Act comes into full effect in June 2022. In the webinar series, Kasamesunt and Pongpalin provided a comprehensive overview of obligations of the data controller and data processor; discussed civil liability, criminal offenses, and administrative penalties; addressed enforcement structures; covered complaint proceedings; and shared case studies from Europe to highlight mistakes that Thai companies should learn from.
