Nandana Indananda Featured in Article on ASEAN Law Association Meeting

Nandana Indananda, a partner in Tilleke & Gibbins’ intellectual property practice, was interviewed by the Thai Post for their recent article about the ASEAN Law Association (ALA) Governing Council Meeting, which took place on November 21–22 in Phuket. Nandana, who is also vice president of the Lawyer’s Council of Thailand’s (LCT) subcommittee on foreign affairs, was joined at the event by Waralee Sripawadkul, attorney-at-law in the firm’s intellectual property group. Together they represented Tilleke & Gibbins at the two-day meeting.

The Thai Post article summarized the meeting, which was organized to promote collaboration between lawyers in ASEAN countries and foster cooperation for arbitration and dispute resolution in the region. Participants included judges (Nandana is himself a former judge of the Intellectual Property and International Trade Court), attorneys, representatives from the Office of the Attorney General, public prosecutors, legal professors, and others.

The newspaper went on to interview Nandana about the LCT and the role of law firms in general in Thai society. Nandana explained that the LCT oversees attorneys and law firms to ensure that they uphold professional standards. He also discussed the activities of law firms in providing legal consultation, particularly for business owners who would like to operate in Thailand and ASEAN countries. He emphasized that being equipped with legal knowledge of each jurisdiction is crucial for investors and entrepreneurs looking to do business in other countries, and he brought up the work Tilleke & Gibbins does advising on trading, investment, intellectual property registration and much more for Thai and foreign business owners who would like to expand their business operations to new locales.

Finally, Nandana noted how the LCT and law firms in Thailand give back to society through pro bono services for Thais and expats in need and by providing legal advice to foundations and NGOs.

On November 25, Wiramrudee (Pink) Mokkhavesa, a partner in Tilleke & Gibbins’ intellectual property group in Bangkok, joined a panel in an ASEAN IPA webinar titled “Online Enforcement of Intellectual Property Rights.” Together the panelists discussed the impact of internet-based technologies and possible strategies for tackling infringement in the ASEAN region. Wiramrudee, who represented Thailand, was joined on the panel by speakers from Singapore and Vietnam. The webinar provided an overview of the online counterfeit trade and how it affects all types of businesses, from multinationals to SMEs, and discussed the most relevant current and future online counterfeiting threats. Panelists then exchanged views on approaches to dealing with these emerging online infringement risks to ensure that attendees are prepared to face the latest counterfeiting and infringement trends. The session concluded with a Q&A session and a closing statement by the moderator.

On November 18, John Frangos, partner and deputy director of Tilleke & Gibbins’ dispute resolution and litigation group, spoke in an online session for the Practising Law Institute (PLI) titled “Investor-State Dispute Settlement: Strategic Enforcement of Arbitral Awards.” The session was part of a three-day PLI program on international investment law and settlement of disputes between investors and the state. The program was organized to provide an overview of the relevant law and practice in the area of international investment disputes, and to facilitate consideration of dispute resolution mechanisms such as international arbitration proceedings against states under international investment agreements. During the session, John was joined by experts from Europe, the Americas, and Africa and the Middle East. Each outlined strategic enforcement of arbitral awards in their respective region, and shared insights on how enforcement of arbitral awards can bring a conclusion to long-running international investment disputes with state actors. In attendance were attorneys and others investor representatives from around the world who were looking to better understand the process of international arbitration proceedings in investor-state disputes.
