Myanmar Times Quotes Several Tilleke & Gibbins Professionals on Legal Reforms

The Myanmar Times,  Myanmar’s oldest privately owned English language newspaper, recently quoted several members of Tilleke & Gibbins in a wide-reaching article on the country’s ongoing economic, social, and political reforms.

Asked to comment on Myanmar’s new Companies Law, which came into force on August 1, 2018, Yuwadee Thean-ngarm, director of Tilleke & Gibbins’ Yangon office, discusses the potential for transformative change to the economy that the new law offers. “It will increase investors’ confidence in the country, and the further removal of red tape will allow more investment inflow,” she is quoted as saying. Looking to the broader context, however, Yuwadee acknowledges that “some foreign investors may still be hesitant … due to the situation in the Rakhine state, among other things,” referring to recent events in the country’s northwest.

The law also introduces an online digital registration system for companies—MyCo—on which Sher Hann Chua, a consultant in Tilleke & Gibbins’ Bangkok and Yangon offices, was asked for her insight. She is quoted as saying that the new system will make due diligence on prospective local partners easier for foreign investors, and generally improve investor confidence in the country’s business and economic outlook.

Looking to the future, Santhapat Periera, a partner in Tilleke & Gibbins corporate and commercial department specializing in foreign investment in Southeast Asia, identified the lack of regulations governing intellectual property and data protection as areas of concern. However, the outlook remains positive, with Santhapat noting that “[t]here are draft intellectual property laws pending before the Parliament, and it is hoped that these bills will be enacted into law very soon.”

Suebsiri Taweepon, a partner in Tilleke & Gibbins’ intellectual property group in Bangkok, was elected president of the Intellectual Property Association of Thailand (IPAT) when the association’s board members convened an online voting session to select new leadership. Suebsiri was the unanimous choice of the 15 board members of IPAT. As president, Suebsiri will guide IPAT in setting its program of seminars and events related to current developments in intellectual property in the country. He will also represent the association and provide oversight in relation to IPAT’s participation in regional and international initiatives. Established in 1972, IPAT is a leading intellectual property association in Thailand, and Tilleke & Gibbins has played an active role in the ongoing development of the group for many years. Darani Vachanavuttivong, managing partner of Tilleke & Gibbins and managing director of the firm’s intellectual property practice, served on IPAT’s board from 2001 to 2019 and was president of the association from 2005 to 2009.

Charuwan Charoonchitsathian, a partner in Tilleke & Gibbins’ corporate and commercial group in Bangkok, was featured in a recent Asian Legal Business article on M&A trends and how firms are adapting their transactional legal work to embrace new technologies. The interview was part of their September 2022 issue, in which the magazine announced their annual Asia M&A rankings. Charuwan represented Tilleke & Gibbins (which received rankings in both Thailand and Vietnam) to offer insight into how the firm has seen various new technologies gain prominence in the M&A space in Southeast Asia. On July 27, Dino Santaniello, head of Tilleke & Gibbins’ office in Laos, spoke at a breakfast talk on intellectual property law. The breakfast talk, which was held in a hybrid format to accommodate remote attendees, was organized in collaboration with Department of Intellectual Property, the European Chamber of Commerce and Industry in Laos (ECCIL), and the South-East Asia IP SME Helpdesk. Dino was joined by the director of the Department of Intellectual Property in Laos, who discussed the benefits of trademark registration, principles and functions of a geographical indication. Dino then highlighted current enforcement measures as well as the importance of registered trademarks for international and Lao companies to ensure that brands are well-aware of their rights and protections under the law. The ECCIL promotes the interests of the European business community in Laos and serves its members by organizing events and networking opportunities and assisting European companies with market entry into Laos.
