Managing IP: Thang Duc Nguyen and Linh Thi Mai Nguyen Quoted on Vietnam’s IP Procedures

On January 15, 2018, Vietnam implemented changes to its patent and trademark examination procedures to bring them more in line with international standards. In a recently published article on the revamped procedures, Managing Intellectual Property quoted two lawyers from Tilleke & Gibbins’ Hanoi office.

Commenting on the fact that new details can no longer be introduced at the appeal stage, Thang Duc Nguyen, head of patent, explained that the change was aimed at reducing the number of appeals. “When applicants supplement new facts or arguments at the appeal stage, it led to a huge appeal workload and numerous unsettled and long-pending requests.”

Regarding the extended deadlines for responding to office actions, Linh Thi Mai Nguyen, head of trademark, shared, “The periods in the old circular were quite short compared to other countries, which caused difficulty for applicants, especially overseas ones, to meet the deadlines. IP practitioners find the extended periods more reasonable and provide a more practical timeline for response.”

Tiziana Sucharitkul, co-managing partner and director of the Tilleke & Gibbins’ dispute resolution group, has been invited to speak at a webinar on May 7, 2021, on diversity and inclusion (D&I) policies and practices at law firms. The webinar is organized by the International Bar Association (IBA) Law Firm Management Committee and will feature insights from several members of IBA leadership as well as other senior professionals from leading law firms and companies around the world. On February 1, 2021, the Myanmar military declared a state of emergency in the country and took control of the government, arresting State Counsellor Aung San Suu Kyi, President Win Myint, and other senior government officials from the National League for Democracy. The seizure of power, and the government’s subsequent actions to suppress public protest and dissent, have received widespread international condemnation.  The USA, Canada, and the UK have reacted by imposing economic sanctions on certain companies and individuals, and more sanctions are expected as the situation in Myanmar evolves. These sanctions pose a major concern for foreign investors with interests in Myanmar—concern which is exacerbated by the lack of clarity about the current situation on the ground. On February 4, 2021, partner Linh Thi Mai Nguyen, the head of Tilleke & Gibbins’ Vietnam trademark group, joined a panel of experts at a “Flash Briefing” webinar organized by the International Trademark Association (INTA) to discuss the proposed amendments to Vietnam’s Intellectual Property Law. Linh, a member of INTA’s Trademark Office Practices Committee, spoke primarily about the changes to Vietnam’s trademark office practice under the amended IP Law, which is currently in draft form and is expected to be issued later this year. This was the first Flash Briefing ever staged by INTA. The format is designed to provide quick online updates on timely issues for brand owners around the world.
