Jay Cohen Discusses Cambodia’s Planned Commercial Court with ALB

Jay Cohen, partner and director of Tilleke & Gibbins in Cambodia, is quoted extensively in a recent Asian Legal Business (ALB) article on Cambodia’s plans to establish a commercial court to adjudicate business disputes. As the article explains, this new judicial body will help relieve pressure on Cambodia’s court system by handling all business disputes, which currently add to the docket of the country’s criminal courts.

In the article, Jay provides some context for the planned development, outlines some of the most notable changes that will result from the move, and explains how the establishment of the court will likely strengthen investor confidence by adding a measure of predictability. The article also includes Jay’s thoughts on how the new judicial structure will relate to the use of commercial arbitration, as well as the possibility of procedural changes that will make dispute resolution easier for foreign investors, such as submission of documents in English.

Noppramart Thammateeradaycho, a counsel in Tilleke & Gibbins’ dispute resolution practice, has been appointed as an arbitrator by the Shenzhen Court of International Arbitration (SCIA). Noppramart is a recognized leader in international arbitration in the region, with special experience in arbitration of disputes involving the maritime, transportation, insurance, and construction sectors. Her term as an arbitrator will run until February 20, 2025. The SCIA, which was established in 1983 as China was undergoing economic reforms and liberalization, was the first arbitration institution in the Guangdong-Hong Kong-Macao Greater Bay Area. Noppramart Thammateeradaycho, a counsel in Tilleke & Gibbins’ dispute resolution practice, has been appointed to the new panel of arbitrators announced recently by the Shanghai Arbitration Commission (SHAC). Noppramart, who was one of two attorneys from Thailand named to the new SHAC arbitration panel, will provide particular support in relation to arbitration of disputes involving the maritime, transportation, insurance, and construction sectors. She is joined on the panel by arbitrators from a wide range of professional backgrounds, with expertise diverse fields including economics, judicial procedure, business, intellectual property, finance, and many more. SHAC, which has grown considerably since its establishment in 1995, is one of the major international arbitration institutions in China. It provides alternative dispute resolution services to companies, organizations, and individuals involved in contentious matters that both parties have agreed to resolve through arbitration rather than litigation.

Dr. Vinh Quoc Nguyen, a partner with the corporate and commercial team in Tilleke & Gibbins’ Ho Chi Minh City office, has been elected to serve a one-year term as chair of the Vietnam Business Lawyers Club (VBLC), a leading professional organization affiliated with the Vietnam Bar Federation. VBLC was established in 2015 with the mission of developing a collaborative group of Vietnamese lawyers engaged in cross-border commercial practice. In addition to providing a forum for practitioners to share experience and offer mutual support, VBLC regularly conducts classes and seminars, and advises lawmakers on policy issues. A well-known figure in Vietnam legal circles, Dr. Vinh is also a lecturer at the Judicial Academy and an arbitrator with the Vietnam International Arbitration Centre (VIAC). In November 2021, he was honored by Vietnam’s Ministry of Justice for his contributions to the development of the country’s legal practice.
