Indonesia Imposes Stringent Requirements on Electronic Cigarettes

Government Regulation No. 28 of 2024 (“GR No. 28”) was issued on July 26, 2024, to implement Law No. 17 of 2023 on Health (the “Omnibus Health Law”). GR No. 28 contains extensive provisions on tobacco products and electronic cigarettes in an effort to reduce the health risks associated with addictive substances, decrease the prevalence of smokers, and prevent the initiation of smoking among beginners in Indonesia.

The Indonesian FDA (known as “BPOM”) is working to implement the relevant provisions in GR No. 28 and has subsequently issued a draft regulation on the control and distribution of tobacco products and electronic cigarettes. This draft regulation is set to replace current BPOM Regulation No. 41 of 2013, which only covered tobacco products. The new draft regulation, however, also incorporates rules on electronic cigarettes.

This article outlines some of the measures on electronic cigarettes contained in GR No. 28 and the draft implementing regulation, focusing particularly on testing and reporting requirements, sale and pack size requirements, and labeling and advertising requirements.

Testing and Reporting

The draft regulation requires that each variant of electronic cigarettes produced or imported be tested for nicotine content. These tests must be conducted in an accredited laboratory, and the results must be reported to BPOM.

The use of additive materials is prohibited unless they have been proven safe for public health. To enforce this, electronic cigarettes must be tested for the presence of prohibited additives before they are distributed. Additionally, a verification of the content of prohibited additives must be conducted during the distribution period, with the testing and verification being carried out in different laboratories. The results of both tests (i.e., the pre-distribution test and the subsequent verification) must be reported to BPOM.

Sale and Pack Size

GR No. 28 prohibits the sale of electronic cigarettes:

  • Via self-service machines;
  • To individuals under the age of 21 (an increase over the previous minimum age of 18 years old) or to pregnant women;
  • In locations near entrance and exit doors or in high-traffic areas;
  • Within 200 meters of children’s educational facilities or playgrounds; and
  • Through web services, commercial electronic applications, or social media platforms without age verification.

GR No. 28 also establishes pack size requirements for electronic cigarettes. For closed-system or single-use cartridge electronic cigarettes, the liquid nicotine content must not exceed 2 mL per cartridge, and each package cannot contain more than two cartridges. For open-system or refillable electronic cigarettes, liquid nicotine must be sold in 10-milliliter or 20-milliliter containers. For solid electronic cigarettes, there must be 20 sticks per pack.

Labeling

Electronic cigarette labels are required to display health warnings in both text and image format, providing educational information about the risks of smoking. These health warnings must be printed on the package surface as an integral part of the packaging. There are five different required warnings for each variant of electronic cigarette. Each of the five warnings must be equally displayed on all of the electronic cigarette packs for each variant.

The health warning text and images must be displayed on all sizes of electronic cigarette packages. Each package must show one type of health warning, which cannot be obscured by anything else. The warning must meet the following criteria:

  • The warning must be displayed on the top portion of the package (horizontal orientation), on both the front and back, covering 50% of the surface area;
  • The packaging must include the word “warning” in yellow text that stands out clearly on a black background;
  • The image must be printed in color; and
  • The font must be Arial Bold, proportional to the package size, with yellow text on a black background.

The draft regulation also requires electronic cigarette labels to include the following information:

  • A statement that the product contains nicotine;
  • A statement that the product is prohibited from being sold or provided to individuals under the age of 21 or to pregnant women; and
  • The production code; date, month, and year of production; and the name and address of the manufacturer.

The label must not contain any misleading information or sign or any promotional wording.

Advertising

GR No. 28 stipulates extensive advertising requirements for electronic cigarettes. Advertising on digital-based social media platforms is prohibited. GR No. 28 also specifies requirements for advertisements placed on websites and commercial electronic applications. requirements for advertisements at point-of-sale locations and via outdoor media, print media, and broadcasting media.

Advertisements on websites or commercial electronic applications:

  • Must include a health warning and a statement prohibiting the sale or provision of electronic cigarettes to individuals under the age of 21 and to pregnant women;
  • Must not illustrate or suggest that using electronic cigarettes offers health benefits;
  • Must not use misleading words or phrases or encourage the consumption of electronic cigarettes,
  • Must not depict the use or display of electronic cigarettes or any references that could be associated with the brand;
  • Must not feature children, teenagers, or pregnant women in any pictures or text;
  • Must not target children, teenagers, or pregnant women;
  • Must not use cartoons or animation as advertising characters;
  • Must not contradict public norms;
  • Must implement age verification to limit access to those 21 years old and above.

Conclusion

Businesses operating in the electronic cigarette industry in Indonesia need to stay vigilant and proactive in response to these new regulatory requirements. Compliance will not only require adjustments in production, packaging, and marketing strategies but also proactive due diligence to avoid potential legal repercussions. Companies should consider conducting comprehensive audits of their current practices and seek legal counsel to ensure full compliance with the evolving regulatory landscape. By doing so, they can better navigate the complexities of these stringent regulations and mitigate risks that could impact their market presence and operational continuity.

On July 13, 2022, the Vietnamese government issued Decree No. 46/2022/ND-CP amending and supplementing some articles of Decree No. 13/2020/ND-CP providing detailed guidance on the Law on Animal Husbandry (“Decree 46”). The new decree took effect on the issuance date. Among the changes introduced by Decree 46 are a number related to animal feed. Recognition of Testing Methods of Exporting Countries Decree 46 clarifies the steps to recognize animal feed testing methods of laboratories in exporting countries. Under the amended regulations, the Department of Livestock Production (DLP) will organize an assessment team to appraise each dossier for recognition of animal feed testing methods within 30 days of receipt of a complete dossier. If the dossier lacks required information or authenticity, the DLP will organize a practical assessment team at the exporting country’s testing laboratory. If the dossier passes the assessment, within five working days from the completion of the assessment, the DLP will issue a decision on recognition of the testing method. The validity of this decision has been lengthened from three years to five years. State Inspection of Animal Feed Quality Process of State Inspection Decree 46 specifies the process to conduct state inspection of the quality of imported animal feed by unifying the regulations stipulated in the related legal documents listed in Decree 13. The process includes the submission of a state inspection dossier, timelines to receive feedback from the inspection authority, and further steps that can be taken upon receiving acceptance or refusal decisions from the authority. For traditional animal feed and complete compound animal feed, imported shipments are customs-cleared as soon as the importer completes the customs procedures. Within 15 days from the customs clearance date, the importer must submit the conformity assessment results. The importer has complete responsibility for the conformity assessment results, and

In late 2021, the government of Vietnam issued Decree 98 on the management of medical devices (Decree No. 98/2021/ND-CP dated November 8, 2021), which came into force on January 1, 2022. This is the primary legislation on medical devices in Vietnam. To provide necessary guidance and elaboration on the implementation of Decree 98, the Ministry of Health recently issued Circular No. 05/2022/TT/BYT dated August 1, 2022 (“Circular 05”), which took effect on the same day. The most notable aspect of Circular 05 is that it unifies, in a single legislative document, previous regulations on medical devices that were scattered in multiple circulars issued by the Ministry of Health (Circular No. 39/2016/TT-BYT dated October 28, 2106; Circular No. 46/2017/TT-BYT dated December 15, 2017, as amended by Circular No. 23/2021/TT-BYT dated December 9, 2021; and Circular No. 33/2020/TT-BYT dated December 31, 2020). The effectiveness of these circulars was terminated when Circular 05 took effect. Circular 05 sets out regulations and principles for the classification of medical devices, and adds or supplements the following lists: List of in vitro diagnostic medical devices (IVD) not subject to quality assessment by Vietnamese competent authorities when registering under the quick registration procedure. List of class B, C and D medical devices allowed to be traded as normal goods. List of medical devices required to be accredited for safety and technical functions before use. List of medical devices requiring import permit licenses. While Circular 05 does not introduce major changes to the previous regulations, the consolidation and up-to-date guidance on Decree 98 will simplify the task of registration and circulation for medical device companies doing business in Vietnam.

Cosmetics have become an essential feature of the modern lifestyle led by many consumers in Cambodia. Every day, a wide range of new cosmetic brands, variants, and formats enter the Cambodian market, catering to a growing consumer base. The market generally relies on the import of foreign cosmetic brands, making Cambodia an attractive market for overseas cosmetics companies, but local brands are on the rise as well. Alongside the significant growth of the cosmetics market in Cambodia, and the Royal Government’s continuing push to increase consumer protection in Cambodia, in 2022, the Ministry of Commerce (MOC) issued Prakas No. 0064 on the Requirements for Cosmetic Distribution (the Prakas). The Prakas applies to both locally manufactured and imported cosmetics, and both individual and businesses that trade in cosmetics. The Prakas aims to regulate cosmetics and cosmetic business activities, to ensure that cosmetics distributed in Cambodia are of good quality and safe for use.  The key points contained in the Prakas are summarized below. Legal Obligations for Trading Cosmetics Any person trading in cosmetics, including wholesale or retail, and those that offer cosmetics as gifts or for testing, must ensure that the products are safe and meet the legal labelling requirements. Anyone trading cosmetics must respect the Law on Consumer Protection, with the Prakas highlighting key aspects of that law and referring to the applicable penalties under that law. Online sellers of cosmetics must obtain an additional approval letter (for individuals) or a license (for legal entities) to operate an online business, issued by the MOC. In addition, they require a certificate for providing online services from the Ministry of Post and Telecommunications. What does “digital health” include within each jurisdiction? Thailand: For the most part, the idea of “digital health” or “telemedicine” has generally fallen within the area of medical device regulation in Thailand. The normal sort of digital health components you would think of—like software and device accessories for diagnosis, monitoring, prevention, or treatment of illnesses—would fall into medical device classification, so long as they do not achieve their intended function by immunological, metabolic, or pharmacological means. The “digital health” devices you commonly think of, like mobile medical apps, wearable technologies and software, fall mainly within this definition. After the last update to the Medical Device Act in 2008, Thailand next looked at digital health in 2019, with the Personal Data Protection Act (PDPA)—which is largely aligned with GDPR principles—and the Cybersecurity Act. These deal with important issues arising from “digital health” and “telemedicine” like personal data protection, consent to use and consent to transfer data, and privacy. Vietnam: Similarly, in Vietnam, while there’s not a clear definition of “digital health” in the law, it is understood to include various types of medical devices, software, and online services used for healthcare purposes—including diagnosis and treatment as well as medical records and telemedicine. There’s no law on digital health, per se, but many of these areas are covered by separate circulars issued by the Ministry of Health. There’s a circular (referred to as “Circular 49”) from late 2017 on telemedicine, for example, that actually uses the term “telemedicine” to identify the industry and sets out licensing and technical requirements. Indicators such as this show that Vietnam is definitely embracing the concept.
