The Data Privacy Asia 2016 conference, which will be held in Singapore on November 9-11, 2016, features a strong lineup of speakers focusing on data protection regulations, big data, cyber security, data breaches and response plans, and more. With tracks focusing on (1) privacy regulations and compliance in the digital age and (2) privacy challenges for information technology and security, the conference will provide an opportunity to hear from thought leaders in this area from ten jurisdictions across Asia.

The conference will include two separate presentations from Jeffrey J. Blatt, of counsel at Tilleke & Gibbins, focusing on the following topics:

  • Government Surveillance, Security, and Privacy: Does Security Always Win? This session, structured as an interactive discussion, will review how to strike the balance between taking advantage of the huge amounts of data we create every day, on the one hand, versus the dangers of allowing unchecked access to that data for surveillance purposes, on the other.
  • The Encryption and Lawful Access Debate in Thailand and the U.S.: One Step Forward and Two Steps Back. Governments in both Asia and the West are enacting laws designed to compel Internet service providers, platforms, and enterprises to disclose subscriber user data, including emails, search and location histories, chats, photos, and even health information in response to lawful government access requests. This session will review the latest developments in this area and consider the legal and commercial ramifications.

Michael Ramirez, a counsel in Tilleke & Gibbins’ dispute resolution group in Bangkok, will provide the Thailand legal outlook at a Thailand Regional Forum meeting to be held at Sasin School of Management on June 9, 2022. The event will be a special relaunch meeting of the Thailand Regional Forum, an initiative established by Dataconsult some 35 years ago. After a hiatus during the COVID-19 pandemic, the forum is restarting with Sasin School of Management as its new home. On May 24, 2022, Tilleke & Gibbins was joined by the British Chamber of Commerce Thailand (BCCT) in holding an event entitled “7-Day Countdown: What to Know about Personal Data Protection Act Enforcement” at the Conrad Bangkok hotel. The event aimed to equip the British business community in Thailand with essential knowledge to be fully compliant with the law. During the event,  Nopparat Lalitkomon, senior associate, and Gvavalin Mahakunkitchareon, associate, walked attendees through the following key considerations: Roles and responsibilities of data controllers and data processors; Management of personal data collected prior to the effective date of the PDPA; and Practical advice to avoid potential pitfalls. The event concluded with a networking reception in which participants had an opportunity to connect and discuss further details with the firm’s PDPA experts.

On April 20, three attorneys from Tilleke & Gibbins’ corporate and commercial group—Gvavalin Mahakunkitchareon, associate; Nopparat Lalitkomon, senior associate; and Pongpalin Chantrapirom, associate—offered a Thai-language webinar entitled “Personal Data Protection Compliance Preparation.” During the session, the three speakers gave a comprehensive overview of Thailand’s data protection regulatory regime to assist attendees in complying with the Personal Data Protection Act BE 2562 (PDPA), which will come into full effect on June 1, 2022. In particular, the speakers covered the following topics: Key principles of personal data collection; PDPA compliance considerations for insurance companies; Notification of data collection and data processing in accordance with the law; Managing personal data collected prior to the effective date of the PDPA; Penalties for noncompliance with the PDPA; and Comparative case studies involving the EU’s GDPR (General Data Protection Regulation). On April 8, Nopparat Lalitkomon, senior associate in the firm’s corporate and commercial group in Bangkok, took part in a webinar titled “Be Ready for Thai PDPA,” cohosted by Cisco Systems. The virtual event aimed to assist businesses in preparing for enforcement of Thailand’s Personal Data Protection Act (PDPA), which takes full effect on June 1, 2022. In his presentation, which was titled, “Get Ready for PDPA: Timeline, Regulations and What’s to Come,” Nopparat outlined the key principles of the PDPA and its related regulations, and highlighted necessary steps that Thai companies need to take as the deadline draws closer. At the conclusion of the session, He provided attendees with practical advice they can use to help their companies effectively manage their internal system to comply with the PDPA in June.
