AMCHAM Thailand Event: Consumer Protection and Product Liability Legislation

Chitchai Punsan, an attorney-at-law in Tilleke & Gibbins’ dispute resolution and litigation department, will join a panel discussion as a speaker to deliberate on the topic “Consumer Protection and Product Liability Legislation: Five Years On.”

Chitchai will delve into his own personal experiences in handling consumer protection and product liability matters during his time working for and representing companies doing business in Thailand. He will provide insight into the impact and implications of recent amendments made to consumer protection legislation, most notably of which grants the Consumer Protection Board authority to issue orders and take action against products it deems potentially harmful to consumers. Chitchai will also comment on a number of pertinent case studies to assist business owners and operators in developing consumer case strategies.

The National Legislative Assembly recently passed a bill amending the Civil Procedure Code to allow for class action legal proceedings in Thailand. The bill has received royal endorsement, and it will become effective in December 2015. While litigation prospects in Thailand are potentially more limited than those in other jurisdictions, such as North America, the legislation is nevertheless expected to have a significant impact on business operators.
