Airline Industry Article Quotes John Frangos on Latest Developments in Thai Airways Rehabilitation

A recent article on the progress of the business rehabilitation of Thai Airways quotes John Frangos, partner and deputy director of Tilleke & Gibbins’ dispute resolution department, on various aspects of the developing case. The article, titled “Lessors strike deals with Thai Airways,” was written by airline industry business information provider Cirium and shared through FlightGlobal, the world’s leading publisher of news, analysis, and other content for the aviation industry.

The article reports that the majority of the aircraft lessors who have exposure to Thai Airways are in the final stages of signing agreements with the beleaguered airline to govern management of their aircraft in the business restructuring process.

In discussing his own experience representing various creditors in the process, John explains that the airline may be adopting a blanket policy of objecting to requests for debt repayment. “It appears to be a clear strategy of the plan preparer to object to many debt-repayment applications as a way to try to reduce the overall debt amount,” he is quoted as saying.

The article also notes that there is still considerable uncertainty surrounding the ongoing business rehabilitation. Part of this is related to the future makeup of the carrier’s reduced fleet, but the most pressing issue is whether Thai Airways will submit its rehabilitation plan by the March 2, 2021, deadline.

If this deadline is not met, one possibility is that the airline would have to file for dissolution. However, John considers that even if they miss the deadline, other workarounds will be explored.

“If they don’t finish and they do legitimately need more time, then at least for me personally I can’t see the whole process unravelling because they can’t submit by the deadline,” he says.

An article in Global Restructuring Review on the Thai court’s approval of Thai Airways’ business rehabilitation plan features insights from John Frangos, partner and deputy director of Tilleke & Gibbins’ dispute resolution department. The article reports that the airline’s rehabilitation plan has received court approval, over objections from two of the creditors. This step will now allow the airline—which has received over 13,000 debt repayment claims—to implement plan under the control of five administrators. John, who co-leads the firm’s regional aviation practice, explained a number of issues to the article’s author, including the Thai government’s unwillingness to bail out the financially troubled company, the challenges facing Thai Airways (and the Thai aviation industry as a whole) during the pandemic, and the historic nature of this bankruptcy case. The latest “Women in Law” report from Asia Business Law Journal (ABLJ) includes a profile of Tiziana Sucharitkul, co-managing partner and director of the Tilleke & Gibbins’ dispute resolution group. The special report includes profiles of 20 highly accomplished female legal professionals from the Asia-Pacific region. Tiziana is the only person from Thailand to be included in the feature. Titled “View from the Top,” the profile of Tiziana focuses on her many leadership roles—not only at the helm of Tilleke & Gibbins but also in executive and advisory positions for various global legal associations. For instance, in 2018–2019 Tiziana served as chair of the board of Lex Mundi, the world’s leading global network of independent law firms, and she currently sits on the board of the Lex Mundi Pro Bono Foundation and is an active participant in the organization’s Women’s Initiative Network to Success. Tiziana also sits on the International Bar Association’s Law Firm Management Committee, which functions as a global forum for leadership and management in the legal practice.
