Biography

Vongkhim Lay is an associate in the intellectual property team of Tilleke & Gibbins’ Phnom Penh office. Vongkhim advises and assists clients with a wide range of intellectual property issues, including IP prosecution, anticounterfeiting strategies, and enforcement actions.

As a licensed trademark agent, Vongkhim represents her clients before government bodies such as Cambodia’s Department of Intellectual Property (DIP) and other relevant authorities by responding to office actions, acting for clients in opposition and cancellation proceedings, participating in DIP mediation proceedings, and pursuing trademark enforcement actions. Through her persistent efforts, Vongkhim fights to secure and defend the valuable intellectual property of all clients, from large multinational brands active in the Cambodian market to regional and local companies looking to assert their rights.

Prior to joining Tilleke & Gibbins, Vongkhim worked for both local and international law firms, specializing in IP and commercial matters. Vongkhim is a licensed trademark agent in Cambodia, and she speaks Khmer and English.

Experience

  • Advised and assisted clients on trademark-related issues, including trademark searches, trademark registration applications, affidavits of use/non-use, recordal of changes in applicant details and assignment, renewals, oppositions and cancellations, and other relevant actions.
  • Advised clients on licensing and franchising regulatory and registration requirements in Cambodia, reviewed license and franchise agreements to ensure compliance with Cambodian laws and regulations, and recorded the agreements with the Department of Intellectual Property.
  • Guided and represented clients in pursuing the necessary enforcement actions to obtain compliance from infringers, including investigating suspected infringers, providing strategic plans to cope with counterfeiting or unauthorized trademark use, and negotiating with infringers and relevant authorities.
  • Assisted clients with application filing, responding to office actions, and making timely annuity payment for patents, industrial designs, and copyrights in order to maintain and defend IP portfolios in Cambodia.
  • Provided advice to a global tobacco company on Cambodia’s tobacco regulations, and performed due diligence on potential legal issues and compliance requirements under Cambodian laws and regulations.

Cambodia’s Law on Seed Management and Plant Breeder’s Rights was enacted in 2008, but it was not until recently that new plant varieties could successfully be registered for protection in the country. Although the law has been in place for some time, recent developments confirmed the application process and a schedule of charges for the registration of new plant varieties. With these developments, breeders have been able to register their new plant varieties in Cambodia since March 1, 2024. Applicants for new plant variety protection must be Cambodian nationals, foreign nationals domiciled in Cambodia, or permanent residents of either a country that is a contracting party to the International Union for the Protection of New Varieties of Plants (UPOV) Convention or a country with which Cambodia has signed a memorandum of understanding on plant variety protection. Applicants can also claim a priority date from the first application for the same plant variety filed in any contracting party of the UPOV Convention within 12 months of the earliest application’s filing date. To be eligible for protection, new plant varieties must satisfy the following criteria: Novelty: A variety is considered “new” if, at the date of filing the application for new plant variety protection, it has not been sold, marketed, or otherwise disposed of others—by or with the consent of the breeder—for more than: One year for any plant variety in Cambodia; Six years for trees and vines or four years for all other plant varieties in countries besides Cambodia. Distinctiveness: A variety must be clearly distinguishable from any other existing varieties. Uniformity: A variety must be sufficiently uniform in its relevant characteristics. Stability: A variety must remain unchanged in its essential characteristics at the end of each cycle of propagation and in each generation. The last three criteria are often

Patent prosecution can be a lengthy process, especially in jurisdictions where patent office backlogs impede the timely examination and grant of patents. Acknowledging the imperative for expeditious patent prosecution, numerous patent holders in Southeast Asian (SEA) nations have expressed their eagerness to expedite the process. Consequently, governments in Cambodia, Indonesia, Laos, Thailand, and Vietnam have instituted diverse programs to facilitate swifter patent examination and grant. These programs are implemented either within their own intellectual property systems or through collaboration with other intellectual property offices. Notably, many accelerated examination programs are also available for inventions pertaining to green technologies or matters of public interest. In this article, we will explore a selection of these options, shedding light on the programs that facilitate faster patent examination and grant. While the following sections highlight specific initiatives, it is important to note that there may be other programs and opportunities beyond those mentioned here.   ASEAN Patent Examination Cooperation (ASPEC) Program One of the most notable programs in the region, the ASPEC program offers a mechanism for patent applicants to accelerate the examination of their patent applications in a participating IP office of an ASEAN member state (the second IP office) by leveraging the search and examination reports issued by the participating IP office of another ASEAN member state (the first IP office) on the corresponding application. Patent applications filed in any of the participating ASEAN member states, including Brunei Darussalam, Cambodia, Indonesia, Lao PDR, Malaysia, the Philippines, Singapore, Thailand, and Vietnam, are eligible to benefit from the ASPEC program. An ASPEC request can be filed at any time before the final decision of grant or refusal; however, to maximize the effectiveness of the program, it is advisable to file the ASPEC request concurrently with the substantive examination request—by doing so, the substantive

Intellectual property experts from Tilleke & Gibbins were engaged by ARISE+ IPR, a regional support program funded by the European Union and implemented by the European Intellectual Property Office, to craft a series of IP enforcement guides for Southeast Asian countries, aimed at raising local awareness of the importance of IP protection. The five-year, EUR 5.5 million ARISE+ IPR program supports regional integration through IP cooperation and aims to upgrade national IP systems for creation, protection, utilization, administration, and enforcement to be in line with international best practices and standards and the strategic objectives of the ASEAN Intellectual Property Rights Action Plan 2016-2025. The guides were developed by Tilleke & Gibbins’ lawyers in cooperation with the IP offices of each participating country, and cover issues related to trademarks, industrial designs, and geographical indications. Each guide was produced in a compact leaflet form in English as well as the local language, and is considered an official publication of the respective national IP office.
