Biography

Trung Bao Tran is an associate in the firm’s Ho Chi Minh City office. Trung’s practice focuses on all aspects of tech/media/telecom, data protection, and intellectual property laws. He also handles technology transfer contracting and regulatory advice. Trung excels at research and has served as an active member of EuroCham’s Digital Sector Committee and participated in the Committee’s advocacy programs for legislative projects on Vietnam’s Draft Personal Data Protection Decree and Draft Internet Decree Amendment.

Trung graduated cum laude from the intellectual property LLM program jointly organized by the University of Turin (Italy) and WIPO, and obtained a certification for the CopyrightX program of Harvard Law School.

Experience

Advised a financial service provider on the criminal liability risks of its cyber scanning program.
Advised a financial services company on its AI-based data analytics program and identification check program with multiple solutions and types of data collected.
Advised an IT service management company on its cloud computing services for collection and storage of data in the healthcare industry.
Advised a leading global financial services group and one of the largest banking institutions in Japan on a data analytics program that required transfer of data across multiple countries for outsourcing of data processing.
Advised on personal data protection, bank secrecy, and state secret transfer restriction issues in a bank’s data analytics program, which involved transfer of both ordinary personal data and data which could be considered as state secrets.
Advised a mass media company on personal data protection and cybersecurity (data localization) issues in its processing of personal data of website users.
Reviewed the personal data collection and processing activities under the Privacy Policy and Cookies Policy of a multinational video game company as part of the due diligence process for an acquisition.
Reviewed a multinational mass media and entertainment conglomerate’s privacy policy for compliance with Vietnam’s data protection and cybersecurity laws.

Highlights of the New Investment and Company Laws of Vietnam

On November 29, 2005, the National Assembly of Vietnam passed, among others, two new laws: (1) the Law on Investment No. 59/2005/QH11; and (2) the Law on Enterprises No. 60/2005/QH11. Both laws will take effect on July 1, 2006. Some of the important changes in the new laws are analyzed in this article.

New Regulations on Foreign Representative Offices and Branch Offices in Vietnam

Only seven months after the enactment of the new 2005 Commercial Law of Vietnam at the beginning of 2006, the Vietnamese Government has issued new regulations on foreign representative offices and branch offices in Vietnam under Government Decree No. 72/2006/ND-CP dated July 25, 2006. Compared with the regulation under the previous decree, this new decree seems to be a step backward in terms of the requirements for opening a foreign representative or branch office in Vietnam. This article describes the setbacks.

World Trademark Review has released the 2023 edition of the WTR 1000—its annual rankings of the leading trademark lawyers around the world.
