WTR Anti-counterfeiting: A Global Guide 2019—Vietnam Chapter

Three intellectual property (IP) practitioners from Tilleke & Gibbins in Vietnam— Loc Xuan Le, principal; Linh Duy Mai, attorney-at-law; and Diep Thi Bich Le, attorney-at-law—have contributed their expertise to author the Vietnam chapter of World Trademark Review’s Anti-counterfeiting: A Global Guide 2019 . This in-depth publication gives trademark and brand protection professionals a local perspective on anti-counterfeiting laws, procedures, and strategies in 22 jurisdictions worldwide.

For each jurisdiction represented in the guide, contributors were asked to address a number of anti-counterfeiting topics, including but not limited to legal framework, border measures, criminal prosecution, civil enforcement, and preventative measures. In discussing preventative measures and strategies, the Vietnam chapter suggests that brand owners adopt “technological measures to protect their products and use unique marking to distinguish genuine products from fakes.”  While this strategy may require more effort to implement initially, it has proved very effective in discouraging counterfeiters and significantly decreasing counterfeiting attempts.

In addition to contributing the Vietnam chapter, IP practitioners from Tilleke & Gibbins also authored the Cambodia and Thailand chapters to the guide.
