Biography

Anh Hoai Nguyen is an associate in Tilleke & Gibbins’ corporate and commercial group in Hanoi. She has experience across a wide range of commercial matters, and is a key contributor to the firm’s tech/media/telecom practice. Hoai Anh was formerly the chief legal officer at a fast-growing fintech group with more than 2,000 employees nationwide where she provided pragmatic, business-minded legal advice to technology experts, start-up founders and innovative product developers. Having spent years following the tech industry, Hoai Anh has in-depth knowledge in fintech, cybersecurity, online games, data privacy, cryptocurrency, intermediary payment services, peer-to-peer lending, and e-commerce. She also has a strong background in IP registration, licensing, and enforcement.

Hoai Anh holds a master’s degree in International Corporate & Commercial Law from King’s College London. She earned her LLB from the Diplomatic Academy of Vietnam, where she was among the top students of the Faculty of International Law and served as student representative for both the university and the Ministry of Foreign Affairs in a number of international moot court competitions.


Experience
  • Advised a number of technology giants on TMT (tech/media/telecom) matters, most notably regarding Vietnam’s regulations on fintech, online games, cybersecurity, and other network-related matters.
  • Concluded one of the largest copyright licensing deals in the Vietnamese music industry by assisting a top overseas Vietnamese music production studio to prepare, negotiate, and sign an agreement on distribution of audio and video recordings with a leading Vietnamese digital content company.
  • Assisted a U.S. industry association to research and develop a comprehensive position paper relating to various IP protection issues in its industry. The position paper will be submitted to relevant government authorities and advocacy bodies to encourage amendments of law.
  • Advised on and handled all matters relating to the establishment and daily operation of representative offices in Vietnam for large Chinese and German corporations, including advising on scope of business activities, employment, and compliance.
  • Reviewed and revised commercial contracts in connection with a wide range of legal issues, including franchising, real property, IP licensing and assignments, distribution of goods, and employment.
  • Assisted one of the largest European pharmaceutical companies in its far-reaching and complicated patent lawsuit against a Vietnamese pharmaceutical company. Our scope of work not only covered court proceedings but also included working with relevant government agencies, such as the National Office of Intellectual Property, Ministry of Science and Technology, and Drug Administration of Vietnam.
  • Advised multiple international companies in their battles against cybersquatters before the WIPO Arbitration and Mediation Center pursuant to the Uniform Domain Name Dispute Resolution Policy (UDRP). In all of the cases, we obtained favorable panel decisions for our clients.
  • Successfully convinced the Vietnam Intellectual Property Research Institute (VIPRI) to review and then re-issue the result of an expert opinion on trademark infringment. As VIPRI is the most specialized agency in the field of IP in Vietnam, convincing VIPRI to reconsider its conclusion was unprecedented.
