Biography

Kasama Sriwatanakul, a counsel in Tilleke & Gibbins’ IP group, specializes in worldwide trademark contentious and noncontentious matters, as well as IP licensing and IP commercialization matters, including drafting, reviewing, and localizing IP-related agreements. Kasama advises multinational and local companies on investing, strategizing, and protecting their trademarks in domestic and overseas markets. She also serves IP clients across a variety of practice areas, including regulatory affairs, licensing, franchising, advertising review, and compliance. Kasama has worked in the firm’s Bangkok and Jakarta offices, and she advises multinational and local companies on investing in, protecting, and commercializing their intellectual property in domestic and overseas markets.

She is recognized as a leading trademark lawyer in Thailand by Who’s Who Legal and is a two-time recipient of the Lexology/ILO Client Choice award in the field of intellectual property for her excellent client care and quality of service.

Kasama holds an LLB and a bachelor’s degree in international relations from Chulalongkorn University, as well as an LLM in international commercial law from the University of Kent in the United Kingdom. She is an admitted member of the Thai Bar Association and the Lawyers Council of Thailand, has completed the barrister-at-law requirements of the Thai Bar Association’s Institute of Legal Education, and is an active member of the Intellectual Property Association of Thailand.


Experience
  • Provides strategic management of trademark portfolios for numerous leading companies around the world through registration, recordations, oppositions, cancellations, renewals, license agreements, watch services, and other related actions.
  • Assisted clients in drafting and negotiating contracts involving IP rights (e.g., copyrights and trademarks) to ensure full compliance and protection under applicable laws and regulations.
  • Reviews and advises on IP commercial contracts, including license and franchise agreements for both domestic and foreign businesses in various industries, including fashion, food, retail, education, film and television, and others.
  • Acted as local counsel for an American television and film producer in their efforts to develop original films and series for local audiences in Thailand, Indonesia, and the Philippines, which included extensive assistance in localizing production agreements and other film production-related agreements, and advice on company establishment, filming and broadcasting regulations, content standards and clearance, and other relevant regulatory concerns.
  • Provided regulatory advice to the local affiliate of a Japanese manufacturer of tractors, harvesters, excavators, and other farming-related equipment.
  • Overcame the rejection of the Japanese registrar on 15 different citations, despite Japanese colleagues believing the chances of success were not positive.
  • Secured recordation of a well-known mark in Thailand for a leading global health company.
