Biography

Joseph Tomkiewicz is a partner and co-chair of Tilleke & Gibbins’ regional energy industry team with nearly 30 years of managerial, transactional, and litigation experience in the world’s largest publicly traded oil and gas companies. He has lived and worked in Thailand, Nigeria, Bangladesh, Qatar, Saudi Arabia, Texas, New York, Washington, DC, Louisiana, and Florida, during which time he has served as an officer, director, and general counsel to several affiliated overseas oil and gas companies. He has significant experience working with various forms of petroleum agreements and has also negotiated and realized contracts for some of the largest-ever industrial constructions. Joseph has many years of experience interacting with senior level ministerial and regulatory government officials in Africa, Asia and the Middle East.

Joseph is admitted to practice in the Commonwealth of Virginia (1991) and in the State of Louisiana (2001).  He is also admitted in the U.S. District Court (Eastern District of Virginia), U.S. Court of Appeals (Fourth, Fifth, Seventh, and Tenth Circuit), and the Supreme Court of the United States of America. In 2022, he was appointed as an international arbitration panelist for the Thailand Arbitration Center (THAC).


Experience
  • Successfully entered into two share-purchase and sale agreements for entities holding oil and gas interests in Cambodia and Vietnam, including overseeing the creation of data rooms, conducting buyer due diligence, and executing the related transactional documents.
  • Successfully bid on and won production-sharing contract rights in two contiguous offshore blocks in Myanmar.
  • Federal Trade Commission (FTC) Request for Additional Information and Documentary Information dated January 15, 1999, regarding the Exxon Mobil merger.  Led a team for Mobil Oil Corporation, which successfully responded to the largest issued second request in FTC history.
  • Maryland Casualty v. Mobil Oil Corporation. In this insurance/personal injury litigation, Mobil successfully enforced a contractual indemnity and its tender of defense in what remains one of the leading insurance defense cases in the state of Illinois.
  • Debra Jean Isaacs v. Mobil Oil Corporation, et al.,United States District Court, Austin, Texas. Directed verdict for Mobil in $58 million copyright-infringement suit over computer software.
