Yuwadee Thean-ngarm and Sher Hann Chua Quoted in WTR Article on Myanmar’s Legal Landscape

Yuwadee Thean-ngarm, director of Tilleke & Gibbins’ Myanmar office, and Sher Hann Chua, a consultant in the firm’s regional intellectual property practice, were featured heavily in a recent article in World Trademark Review  (WTR ) , a leading publication focused on global trademark news and trends. Drawing heavily on the expertise of two of Tilleke & Gibbins’ market-leading professionals, the article discusses how the enactment of the new Trademark Law in Myanmar will shape the legal industry in the jurisdiction over the coming years.

The article notes that Tilleke & Gibbins is one of the few law firms in the jurisdiction actively enforcing trademarks, with Yuwadee and Sher Hann discussing how the process “requires a Myanmar-qualified lawyer who can be an advocate”—something which many international IP practices lack. In addition, enforcement measures in Myanmar sometimes require creative strategies to effectively dissuade infringers from carrying out illegal activities. Yuwadee and Sher Hann explain that “[t]hreatening infringers does not always work,” so alternative, innovative methods are often necessary to produce desired results. They then go on to describe the “educate first” approach used by the firm’s regional IP practice in emerging markets around Southeast Asia that teaches people at the grassroots level about the dangers of counterfeit products.

As a result of the new Trademark Law, firms in Myanmar are already experiencing an influx of trademark work for local, regional, and international clients, and the article closes with Yuwadee and Sher Hann echoing that growth.
