Thailand – Employers Are Now Allowed to Submit Work Rules by e-Filing

In Thailand, employers with ten or more employees must file a copy of their Work Rules (and subsequent revisions) in the Thai language to the Director-General of the Department of Labor Protection and Welfare within seven days from the date the Work Rules are announced. The traditional method to file these documents is to send them by post or in person to the Director-General.

On February 18, 2016, the Thai government issued an announcement which introduces a new e-filing system that allows employers to file their Work Rules electronically, instead of by post or in person. This provides a more efficient mechanism for business operators.

Effective immediately, employers that wish to use the new e-filing system can follow a simple two-step process:

  • Step 1 >> The employer can apply for a User ID and Password via the Department of Labor Protection and Welfare’s website at http://eservice.labour.go.th/eformweb/ (note that the portal is currently available in the Thai language only).
  • Step 2 >> Once the employer receives a User ID and Password via email, they can log in and submit/upload their copy of the Work Rules (and subsequent revisions) through the e-filing system.

An employer can use the e-filing system to file their first Work Rules (to be submitted) as well as any amendments to the Work Rules. The timing of an e-filing is tracked in the host computer of the Department of Labor Protection and Welfare. The Director-General may order an employer who has registered their Work Rules through the e-filing system to submit a hard copy of the Work Rules via another means including post, fax, or in person.
