On January 26, 2012, the Intellectual Property Association of Thailand (IPAT) held a seminar at Thailand’s Department of Intellectual Property focused on patent claim construction and interpretation. The lead speaker at the event was Dr. Jakkrit Kuanpoth, Of Counsel in the Tilleke & Gibbins IP group, who delivered a presentation entitled, “A Comparative Analysis Regarding Patent Claim Construction: The English Purposive Construction and the US Doctrine of Equivalents.”

In his presentation, Dr. Jakkrit discussed literal and non-literal infringement analyses and the role of intrinsic and extrinsic evidence in determining infringement. Through a series of case studies from the late 19th century through today, the presentation reviewed the evolution of patent claim interpretation and the divergence between the US approach, which protects the substance of the invention, and the UK approach, based on the perceived intent of the inventor.
