Biography

Tu Anh Tran is an associate with T&G Law Firm LLC (TGVN), a licensed law firm and IP agent that partners with Tilleke & Gibbins for local IP filings and litigation in Vietnam. He advises and represents clients in resolving commercial disputes by means of court litigation, arbitration, and other ADRs. Recognized as a “Rising Star” in the field of arbitration by The legal 500, Tu is a meticulous and ambitious legal practitioner who has successfully assisted clients in commercial disputes, recognition and enforcement of foreign arbitral awards, aircraft repossession, and other complex matters.

Before joining TGVN, Tu was a legal collaborator at the Vietnam International Arbitration Centre (VIAC). Tu assisted VIAC’s Secretariat and tribunals in administering numerous arbitration cases in a wide range of fields. With his practical experience and insights gained while working at VIAC, he is capable of handling arbitration matters efficiently. He also has substantial experience in the aviation sector, and assists clients with aircraft-related interest registrations and repossession. In addition, he assists with IP enforcement matters with the authorities of Vietnam and is active in pro bono activities regarding IP and arbitration.

Tu is a member of the Chartered Institute of Arbitrators (MCIArb) and has completed with distinction various international arbitration and mediation courses organized by ICC, CIArb, VIArb, and Arbitration Lab.

Experience

Advised and assisted on the first hostile aircraft repossession case in Vietnam against a defaulting Vietnamese airline, with a value of about USD 400 million.
Represented a Singapore-based multinational company in disputes against Vietnamese state-owned companies before VIAC, one of which was valued at nearly USD 16 million, relating to energy project contracts.
Advised a Malaysian company in a contractual dispute against a Vietnamese contractor before the Singapore International Arbitration Centre.
Assisted an Indian IT company in successfully negotiating a settlement with a Vietnamese bank in a USD 10 million contract dispute related to the client’s provision of licensed banking software and related support services.
Represented a Malaysian company in the oil and gas sector in an arbitration case before the Vietnam International Arbitration Centre (VIAC) related to performance of contract in a well plugging and abandonment project.
Represented leading global agricultural corporations in getting foreign arbitral awards of the ICC and ICA successfully recognized and enforced in Vietnam.
Represented a leading multinational agricultural sciences corporation in two consecutive VIAC arbitration cases against defaulting Vietnamese distributors.
Represented a Chinese company in a contract dispute of USD 4 million with regard to the implementation of a hydropower project before VIAC.
Represented a U.S. insurance company in pursuing storage damage claims of a nearly USD 4 million against Vietnamese companies before a local Vietnamese court.
Assisted a Chinese furniture supplier in a contract dispute with a Vietnamese manufacturing company, with a claim of USD 10 million.
Assisted an international sports association in a criminal prosecution against Vietnamese individuals for intellectual property infringement.

Highlights of the New Investment and Company Laws of Vietnam

On November 29, 2005, the National Assembly of Vietnam passed, among others, two new laws: (1) the Law on Investment No. 59/2005/QH11; and (2) the Law on Enterprises No. 60/2005/QH11. New Regulations on Foreign Representative Offices and Branch Offices in Vietnam

Only seven months after the enactment of the new 2005 Commercial Law of Vietnam at the beginning of 2006, the Vietnamese Government has issued new regulations on foreign representative offices and branch offices in Vietnam under Government Decree No. 72/2006/ND-CP dated July 25, 2006. Compared with the regulation under the previous decree, this new decree seems to be a step backward in terms of the requirements for opening a foreign representative or branch office in Vietnam. This article describes the setbacks.
